The Company shall have the right from time to time at its cost and expense, to make additions, modifications, alterations, improvements and changes (collectively referred to as “alterations”) in or to the Equipment, and remove obsolete or worn out Equipment, provided such alterations or removal do not impair the character of the Equipment as a “project” within the meaning of the Act or cause the interest on the Series 2008 Bonds to become includable in gross income for purposes of federal income taxation. All alterations made by the Company to the Equipment shall become the property of the City and remain part of the Equipment, but subject to purchase by the Company under Section 8.4 hereof.

ALTERATIONS TO THE EQUIPMENT. 10.1 The Customer shall without undue delay inform the Contractor by notice In Writing of any alterations in the Equipment or its operation or other measures taken by the Customer which may affect the Contractor’s obligations under the Contract. If such alterations or measures affect the Contractor’s obligations, he is entitled to have the Contract amended. If the parties fail to agree on how to amend the Contract in respect thereof, the Contractor may, with immediate effect, terminate the Contract by notice In Writing to the Customer.
