Aladdin Street Facility. The Contractor currently operates a facility at 000 Xxxxxxx Xxxxxx for the collection, processing and temporary storage of Recyclable Materials. The Contractor shall continue to operate the Aladdin facility in accordance with use permits 95- 10, 96-18 and 97-7. A violation of the use permit is a material breach of this Franchise Agreement. Notwithstanding the terms of such use permit, the Contractor shall obtain the City’s approval of any expansion of the facility or any increase in the volume of materials collected, processed and stored there to the extent that such expansion and/or increase in volume (measured either by tons or cubic yards) is due to customers of the Contractor other than the City of San Leandro. Therefore, should the Contractor obtain other customers, franchises or collection agreements other than for San Leandro, then such increase in volume, capacity or physical expansion shall be approved, conditionally approved or denied by the City. Contractor guarantees adequate capacity, not exceeding permitted volume limits, to the City at the Aladdin Facility throughout the term or any renewal. To the extent that the Aladdin Facility, or other Contractor facilities used in providing Franchise Services are also to provide services other than Franchise Services, the Contractor shall track and recover such data as is necessary to accurately allocate to the City its share of all expenses, revenues, incoming and diverted Tons of Recyclable Materials, and incoming and diverted Tons of Green Waste, and Tons of Residue related to provisions of Franchise Services. The Contractor shall provide the same information for all other jurisdictions or other entities using the facility, and shall make such information available to the City Representative upon written notice. By July 1, 2000, the Contractor shall develop and submit for the City’s review and approval a method(s) for making the allocations specified in this paragraph.

  • Dewatering 4.7.1 Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, all non- trades employees shall assist in ‘dewatering’ their own work site or area if it is so affected. Such work to be paid at single time rates. Productive work will continue in areas not so affected.

  • BUY AMERICA REQUIREMENT (Applies only to Federally Funded Highway and Transit Projects) With respect to products purchased by Customer for use in federally funded highway projects, Contractor shall comply with all federal procurement laws and regulations with respect to such projects, including the Buy American provisions set forth in 23 U.S.C. Section 313, 23 C.F.R. Section 635.410, as amended, and the Steel and Iron Preference provisions of Texas Transportation Code Section 223.045, to the extent applicable. Contractor agrees to provide all certifications required by Customer regarding such programs. With respect to products purchased by Customer for use in federally funded transit projects, Contractor shall comply with all federal procurement laws and regulations with respect to such projects, including the Buy American provisions set forth in 49 U.S.C. Section 5323(j)(1), 49 C.F.R. Sections 661.6 or 661.12, to the extent applicable. Contractor agrees to provide all certifications required by Customer regarding such programs.
