Use Permits. Winstar shall be responsible for obtaining all relevant Use Permits (UPs) and shall bear all costs and fees. Winstar shall regularly apprise BellSouth of the status of such permitting and consult with BellSouth as reasonably necessary.
Use Permits. A certificate of a senior officer of the Company to the effect that (x) attached thereto are true and complete copies of each Use Permit required in connection with such Relevant Transaction for such borrowing and that each such Use Permit is in full force and effect, or (y) no Use Permits are so required.
Use Permits. Lessee shall exercise due care in the installation, use, operation and maintenance of the Equipment, and shall not install, use, operate or maintain the Equipment improperly, carelessly, in violation of any State or Federal Law or for a purpose or in a manner contrary to that contemplated by this Lease. Lessee shall obtain all permits and licenses necessary of the installation, operation, possession and use of the Equipment. Lessee shall comply with all State and Federal Laws applicable to the installation, operation, possession and use of the Equipment, and if compliance with any such State or Federal Law requires changes or additions to be made to the Equipment, such changes or additions shall be made by Lessee at its expense.
Use Permits. The Council shall exercise due care in the use, operation and maintenance of the Facilities, and shall not use, operate or maintain the Facilities improperly, carelessly, in violation of any State and Federal Law or for a purpose or in a manner contrary to that contemplated by this Lease. The Council shall obtain all permits and licenses necessary for the installation, operation, possession and use of the Facilities. The Council shall comply with all State and Federal Laws applicable to the installation, use, possession and operation of the Facilities, and if compliance with any such State and Federal Law requires changes or additions to be made to the Facilities, such changes or addition shall be made by the Council at its expense.
Use Permits. Fuzion shall be responsible for obtaining all relevant Use Permits (Ups) and shall bear all costs and fees. BellSouth agrees to reasonably cooperate with Fuzion with regard to information and/or contact person information related to such Ups. Fuzion shall regularly apprise BellSouth of the status of such permitting and consult with BellSouth as reasonably necessary.
Use Permits. In order to use CRPD facilities in connection with this Agreement, CVUSD shall complete and file with CRPD a permit application, which must be approved by the CRPD Recreation Unit Supervisor for the desired location. The applicable CVUSD school principal must also approve the permit application to ensure that the use is for a verified school event or activity. In order to use CVUSD facilities in connection with this Agreement, CRPD shall complete and file CVUSD Civic Center applications, which must be approved by an authorized CVUSD representative.
Use Permits. Upon application, the GFC may grant a use permit in accordance with the Forests Act No. 6 of 2009. The purposes of use permits are to conduct research and carry out education or training, or similar activities. No commercial harvesting can take place with a use permit.
Use Permits. The Obligors, promptly after the date hereof, shall file all applications, notices and other materials necessary to obtain the Use Permits required in connection with the Abraxas Acquisition and shall take all other actions necessary to ensure that such Use Permits are obtained as soon as practicable after the date hereof.
Use Permits. Teligent shall be responsible for obtaining all relevant Use Permits (UPs) and shall bear all costs and fees. Teligent shall regularly apprise USWC of the status of such permitting and consult with USWC as reasonably necessary. USWC shall cooperate with Teligent, and Teligent shall pay USWC the hourly rates for time reasonably necessary and actually spent by USWC Real Estate or Project Managers on the permitting process. USWC shall have final authority and exercise it in a reasonable manner on all proposed jurisdictional conditions and has the right to be represented at all UP hearings.
Use Permits. Licensee may enter the Licensed Area and Property during the Term for the purpose of using the Licensed Area for general office purposes (the “Permitted Use”). Licensee will not use the Licensed Area or the Property for any other purpose than the Permitted Use. The parties hereby acknowledge that Licensee’s use of the Licensed Area may require certain licenses, permits and other governmental authorizations in order for the Permitted Use to comply with all applicable laws. Licensee shall be solely responsible for obtaining and maintaining throughout the Term all applicable and necessary permits, licenses and other applicable authorizations for the Permitted Use, at its own cost. Licensee hereby agrees that this Agreement is strictly contingent upon obtaining all such necessary permits and licenses. Any vendors, employees or other similar third parties performing work on the Licensed Area or Property or otherwise utilizing the Licensed Area or Property as part of the Permitted Use shall do so under written agreements whereby such parties shall agree to abide by the terms and conditions of this Agreement, including the indemnification provisions, and waive any and all liability, individually and collectively, against the Licensor or its agents. Licensee shall, and shall cause each of the foregoing parties described in the prior sentence to, comply with all applicable laws at all times during the Term of this Agreement. Licensor shall always have the right to suspend Licensee’s access to and use of the Licensed Area and/or the Property and prohibit same from occurring if Licensor determines that there is danger to the Licensed Area or the Property or persons or that Licensee has breached this Agreement.
