Access to and Amendment of PHI. Upon written request by Business Associate, to the extent Business Associate demonstrates that it is incapable of doing so itself and at Business Associate’s cost, Subcontractor shall make PHI in a Designated Record Set available to Business Associate for inspection and copying to enable Business Associate’s Covered Entity or Business Associate customers to fulfill their obligations under the Privacy Rule, including without limitation 45 C.F.R. §§ 164.524 and 164.526. No later than 20 calendar days following a request by Business Associate (unless a longer response time is authorized by Business Associate in writing), Subcontractor shall:

Business Associate shall provide such access and make such amendments within the time and in the manner specified by Covered Entity, including making PHI available in an electronic format to the individual(s) identified by Covered Entity as being entitled to obtain access to that PHI in an electronic format, as necessary for Covered Entity to comply with 45 CFR § 164.524, as amended by the HITECH Act.
Access to and Amendment of PHI. Morehouse shall, to the extent the Participant determines that any PHI constitutes a “designated record set” under the Privacy Regulations, (a) make the PHI specified by the Participant available to the individual(s) identified by the Participant or any Physician as being entitled to access and copy that PHI, and (b) make any amendments to PHI that are requested by the Participant or any Physician. Morehouse shall provide such access and make such amendments within the time and in the manner specified by the Participant to allow the Participant and the Physician(s) to comply with the Privacy Regulations.

Within five (5) business days of receipt of a request from CE for an amendment of PHI or a record about an Individual contained in a Designated Record Set, Business Associate shall make such PHI available to CE for amendment and/or incorporate any such amendment to enable CE to fulfill its obligations with respect to requests by Individuals to amend their PHI under the HIPAA Privacy Rule, including, but not limited to, 45 CFR Section 164.526. If any Individual requests an amendment of PHI directly from Business Associate, Business Associate must notify CE in writing within five (5) days of receipt of the request and make such amendments to the extent required by the HIPAA Privacy Rule. Covered Entity shall be responsible for responding to such requests in accordance with the HIPAA Privacy Rule.

Access to and Amendment of PHI. If Business Associate maintains PHI in a Designated Record Set, Business Associate shall, at the request of Covered Entity and as specifically directed by the Covered Entity,, (1) make the PHI available to an Individual in compliance with 45 CFR §164.524 and section 13405(e) of the HITECH Act and any regulations promulgated thereunder; or (2) make amendment(s) to PHI in accordance with 45 CFR §164.526. If an Individual makes a request for access or for amendment of PHI directly to Business Associate, such request shall be forwarded to Covered Entity in writing within two (2) business days of the request. Covered Entity shall be responsible for responding to such requests in accordance with the regulations.

CHI shall provide such access and incorporate such amendments within the time and in the manner specified by Hospital.
Access to and Amendment of PHI. In accordance with an Individual’s right to access or copy his or her own PHI under 45 C.F.R. § 164.524, and an Individual’s right to append amendments to such PHI under 45 C.F.R. § 164.526, Licensor shall make available all PHI maintained by Licensor in a Designated Record Set to Covered Entity, or to the Individual to whom the information pertains, or to such Individual’s Personal Representative, in any case within twenty (20) days following a written request by Covered Entity. For Designated Record Sets maintained electronically, such access or copies shall be made available in an electronic form or format if requested by the Individual. Licensor shall append amendments to PHI in a Designated Record Set that Licensor maintains, in accordance with a written request from Licensor that includes the nature of the amendment to be appended, within the time period necessary to enable Covered Entity to timely comply with an Individual’s request for amendment under 45 C.F.R. § 164.526.
Access to and Amendment of PHI. Within ten (10) days of receiving a request from Covered Entity for access to PHI about an individual contained in a Designated Record Set, Business Associate shall: (a) make the PHI specified by Covered Entity available to the individual(s) identified by Covered Entity as being entitled to access and copy that PHI, and (b) make PHI available to Covered Entity for amendment purposes and incorporating such amendments into the PHI. Business Associate shall provide such access and incorporate such amendments within the time and in the manner specified by Covered Entity.
