Unappealable definition

Unappealable means a final arbitration award in respect of which any challenge to the award or appeal to the English High Court has been finally determined by the arbitral tribunal or the English High Court or English Appellate Courts in accordance with sections 66 to 71 of the Arbitration Act 1996.

Examples of Unappealable in a sentence

  • For purposes of this Agreement, "Just Cause" shall mean: Unappealable conviction by a trial court of a felony or crime involving moral turpitude; declaration of unsound mind by court order; or the failure to diligently apply himself to the duties required by Employer.

  • The Liquidation Trust Funding Amount will stay in the Liquidation Trust Funding Amount Escrow Account until the Zonda Arbitration Award shall have been issued and shall be final and Unappealable.

  • Competent means the ability of an offeror to satisfy the requirements of the solicitation. This determination is based on a comprehensive assessment of each offeror's proposal including consideration of the specific areas of evaluation criteria in the relative order of importance described in the solicitation.

  • Final means, with respect to the Financing Order, that the Financing Order has become final, that the Financing Order is not being appealed and that the time for filing an appeal thereof has expired.

  • Banking Day means each day (other than a Saturday or Sunday) on which the Clearing System and the Trans-European Automated Real-time Gross settlement Express Transfer-System (TARGET2) ("TARGET2") are open for business.

  • Court of competent jurisdiction means a federal court, or a state court that entered an order in a child custody proceeding involving an Indian child, as long as the state court had proper subject matter jurisdiction in accordance with this chapter and the laws of that state, or a tribal court that had or has exclusive or concurrent jurisdiction pursuant to 25 U.S.C. Sec. 1911.

  • Final Judgment means the Judgment Entered by the Court upon Granting Final Approval of the Settlement.

  • Competent Body means any body that has authority to issue standards or recommendations with which either Party must comply Conditions Precedent means the conditions precedent, if any, to commencement of service delivery referred to in clause A3.2 (Commencement and Duration) and set out in Appendix B (Conditions Precedent)

  • Court means the Supreme Court of British Columbia;

  • Ontario Court means the Ontario Superior Court of Justice.

  • Decree means any judgment, decree, ruling, injunction, assessment, attachment, undertaking, award, charge, writ, executive order, administrative order, or any other order of any Governmental Authority.

  • Order and Final Judgment means the order and final judgment of the Court approving the Settlement Agreement, as described in Section II(E)(7) below.

  • Labour Court means the Labour Court established by section 151 of the Labour Relations Act;

  • the Court means the High Court;

  • Reviewing Authority means the Alberta Securities Commission.

  • Supreme Court means the North Carolina Supreme Court.

  • Jurisdiction means a province or territory of Canada except when used in the term foreign jurisdiction;

  • competent person means a person who has, in respect of the work or task to be performed, the required knowledge, training and experience and, where applicable, qualifications, specific to that work or task: Provided that where appropriate qualifications and training are registered in terms of the provisions of the National Qualification Framework Act, 2000 (Act No.67 of 2000), those qualifications and that training must be regarded as the required qualifications and training; and is familiar with the Act and with the applicable regulations made under the Act;

  • Date of Entry means the date this Consent Decree is approved or signed by the United States District Court Judge.

  • Federal Judgment Rate means the federal judgment rate in effect as of the Petition Date.

  • Tribal Court means a court with jurisdiction over child custody proceedings and that is either a Court of Indian Offenses, a court established and operated under the code of custom of an Indian tribe or any other administrative body of a tribe that is vested with authority over child custody proceedings.
