Spirit Expiration Date definition

Spirit Expiration Date means the earliest to occur of (i) the Company Merger Effective Time, (ii) such date and time as the Merger Agreement shall be terminated pursuant to Article 9 thereof, (iii) such date and time as there shall have occurred either a Change in Spirit Recommendation or a Change in Xxxx Recommendation, (iv) such date and time as either of the Xxxx Parties shall acquire ownership, beneficially or of record, of any Spirit Common Shares and (v) September 25, 2013.

  • L/C Expiration Date means the day that is thirty days prior to the Maturity Date then in effect (or, if such day is not a Business Day, the next preceding Business Day).
