Qualified Military Service definition

Qualified Military Service means any service in the uniformed services (as defined in chapter 43 of title 38, United States Code) by any individual if such individual is entitled to reemployment rights under such chapter with respect to such service.
Qualified Military Service means any service in the “uniformed services” (as defined in Chapter 43 of Title 38 of the United States Code) by an Employee relating to reemployment initiated on or after December 12, 1994, if such Employee is entitled to reemployment rights under such chapter with respect to such service.
Qualified Military Service means service by a Participant or employee in the armed forces of the United States of a character that entitles the Participant or employee to re-employment under the Uniformed Services Employment and Reemployment Rights Act of 1994, but only if the Participant or employee is re-employed during the period following such service in which his right of re-employment is protected by such Act.

  • Contributions owed to the Individual Account of any Participant for a period of Qualified Military Service shall come from investment income or forfeitures, if any, before coming from the Participant’s last employer prior to the period of Qualified Military Service.

  • The hourly Contribution rate shall be the average of Contributions for all Participants during the Plan Year in which the Qualified Military Service was performed.

  • Under Federal law, participants returning to covered employment from full‐time military service, subject to certain terms and conditions, shall, upon reemployment, have their Qualified Military Service be deemed to constitute service with the employers maintaining the Plan for the purpose of determining their right to benefits under the Plan.

  • If a Participant dies on or after January 1,2007, while performing Qualified Military Service (as defined in Code §414(u)(5), the deceased.

  • A Participant who has reemployment rights under USERRA shall be credited with hours worked equal to the average amount of hours earned by the Participant during the 12- month period of employment immediately prior to the period of Qualified Military Service (or, if shorter, the period of employment immediately preceding such period).


More Definitions of Qualified Military Service

Qualified Military Service means any service in the uniformed services (as defined in Chapter 43 of Title 38 of the United States Code or its successor) by an Employee who is entitled to reemployment under such chapter with respect to such service.
