Net Cash From Operations definition

Net Cash From Operations means the gross cash proceeds from Company operations less the portion thereof used to pay or establish reserves for all Operating Expenses, all as determined by the Manager. “Net Cash from Operations” shall not be reduced by depreciation, amortization of intangible assets, cost recovery deductions, or similar allowances, but shall be increased by any reductions of reserves previously established.

Net Cash From Operations means the gross cash proceeds from the Company’s investments, operations, sales, and other dispositions of assets, including but not limited to investment assets (but not including sales and other dispositions of all or substantially all of the assets of the Company), less the portion thereof used to pay, or set aside for, the established reserves for all the Company’s expenses, debt payments, capital improvements, replacements and contingencies, all as determined by the Board of Managers. Net Cash from Operations shall not be reduced by depreciation, amortization, cost recovery deductions, or similar allowances, but shall be increased by any reduction of reserves previously established, but not expended, as authorized by the Board of Managers.

Net Cash From Operations means the gross cash proceeds from ------------------------ Company operations (including sales and dispositions of property in the ordinary course of business) less the portion thereof used to pay or establish reserves for all Company expenses, debt payments, capital improvements, replacements, and contingencies, all as determined by the Manager, subject to the reasonable approval of all of the Members. Net Cash From Operations shall not be reduced by depreciation, amortization, cost recovery deductions, or similar allowances, but shall be increased by any reductions of reserves previously established pursuant to the first sentence of this clause (a) and pursuant to the definition below of Net Cash From Sales or Refinancings.

• If such a determination is made, the Managers will finance the contest of the proposed adjustments out of the Net Cash From Operations.

• Prior to the occurrence of any event specified in Section 9.1, and subject to availability of funds, applicable law, and any limitations contained elsewhere in this Agreement, Net Cash From Operations and Net Cash From Sales or Refinancings may be distributed at such times and in such amounts as may be approved by the Manager, to Common Members in proportion to their respective Percentage Interests.

Net Cash From Operations means the gross cash proceeds from Company operations less the portion thereof used to, or expected to be used to, pay expenses, debt payments, capital improvements, replacements and increases to reserves therefor. Net Cash From Operations means (x) the gross cash proceeds to the Company and the Subsidiaries from operations, less (y) the portion thereof used to pay (or establish reserves for) actual operating expenses and capital expenditures of the Company and the Subsidiaries, including but not limited to real estate taxes, insurance, management and leasing fees, landlord work, tenant inducement costs, debt payments and all required lender reserves, ground rent, capital improvements, replacements and contingencies, Non-Controllable Expenditures, Emergency Expenditures and other operating expenses set forth in the Approved Budget. Any gross cash proceeds of the Company and its Subsidiaries from operations which were used to establish reserves shall be treated as Net Cash From Operations if they are subsequently released.

Net Cash From Operations means Cash Flow, less the amounts set aside for restoration or creation of reserves and for repurchases of Units pursuant to Section 8.11 hereof, if any.

Net Cash From Operations means cash funds from operations of the Trust (including without limitation interest and other investment income and without deduction for depreciation or amortization after deducting funds used to pay or to provide for the payment of all operating expenses of the Trust and each Trust Asset and debt service, if any, capital improvements and replacements), less the amounts set aside for restoration or creation of reserves.
