Moody’s Recovery Rate “Moody’s Recovery Rate” means, with respect to a Defaulted Reference Obligation, the relevant figure (expressed as a percentage) determined by the Calculation Agent in accordance with Moody’s methodology in effect from time to time using the table set out in Schedule 1 hereto.
The “Weighted Average Moody’s Recovery Rate” is, as of any date of determination, the number, expressed as a percentage, obtained by summing the product of the Moody’s Recovery Rate on such Measurement Date of each Collateral Obligation and the principal balance of such Collateral Obligation, dividing such sum by the aggregate principal balance of all such Collateral Obligations and rounding up to the first decimal place.
The Moody’s Recovery Rate of a Collateral Obligation listed in Column B that does not have both a corporate family rating and an instrument rating from Moody’s will be determined under Column C.
Weighted Average Moody’s Recovery Rate: As of any date of determination, the number, expressed as a percentage, obtained by summing the product of the Moody’s Recovery Rate on such Measurement Date of each Collateral Obligation and the Principal Balance of such Collateral Obligation (excluding any Defaulted Obligations), dividing such sum by the Aggregate Principal Balance of all such Collateral Obligations and rounding up to the first decimal place.
The “Minimum Weighted Average Moody’s Recovery Rate Test” will be satisfied on any date of determination if the Weighted Average Moody’s Recovery Rate equals or exceeds 44.0%.
