Members of the Unit definition

Members of the Unit refers to an employee of the District covered by this Agreement. Regular, probationary, temporary or permanent, part-time or full- time classroom teachers including speech therapists, resource teachers, nurses, reading specialists, psychologists, special education and all other regular full- time or part-time certificated employees who are paid on the teachers' salary schedule are considered to be members of the unit. In disputed cases of unit membership, the Public Employment Relations Board shall determine whether a person is a member of the unit.
Members of the Unit refers to all classified employees serving in the classifications listed in paragraph 1.1 of Article I of the Agreement.

Examples of Members of the Unit in a sentence

  • All votes relating to this election shall be by secret ballot and the votes of all Members of the Unit on these matters shall be reported only as an aggregate and not on the basis of contract status or rank.

  • Members of the Unit 2 Association’s bargaining team shall not use State vehicles for transportation to or from bargaining sessions.

  • Subject to the provisions of this Agreement, all bargaining unit Employees (Members of the Unit before July 1, 1989), shall be compensated according to the following formula as a longevity pay.

  • Members of the Unit actively employed in full-time employment positions, may have their children or legal wards attend schools within the District without payment of tuition regardless of the legal residence of the employee.

  • Members of the Unit shall be entitled to leave without loss of pay to appear in court as a witness, other than as a litigant, or to respond to an official order from duly authorized government agencies, or to serve as a juror.

  • Members of the Unit have the absolute right to form, join, or participate in the organization(s) of their choice.

  • Members of the Unit shall be eligible for leave under the Family and Medical Leave Act (“FMLA”) for birth of a member’s child.

  • Members of the Unit will receive mileage allowance in accordance with the rate established by the IRS when required to use their own automobiles in traveling from one work location to another effective January 1, 1992.

  • Members of the Unit employed with effective dates subsequent to July 1 shall be credited with four (4) sick leave days for the first six (6) months of employment and one (1) additional sick leave day per month for the remainder of the first year during which they are employed.

  • Members of the Unit working on other than the day shift will be given an opportunity to attend Unit meetings held in the evening, provided that such meetings are limited to one per month and with the understanding that the employee will complete his/her work on the job.

Related to Members of the Unit

  • Members of the Immediate Family means with respect to any individual, each parent (whether by birth or adoption), spouse, or child or other descendants (whether by birth or adoption) of such individual, each spouse of any of the aforementioned Persons, each trust created solely for the benefit of such individual and/or one or more of the aforementioned Persons, and each legal representative of such individual or of any aforementioned Persons (including without limitation a tutor, curator, mandatary due to incapacity, custodian, guardian or testamentary executor), acting in such capacity under the authority of the law, an order from a competent tribunal, a will or a mandate in case of incapacity or similar instrument. For the purposes of this definition, a Person shall be considered the spouse of an individual if such Person is legally married to such individual, lives in a civil union with such individual or is the common law partner (as defined in the Income Tax Act (Canada) as amended from time to time) of such individual. A Person who was the spouse of an individual within the meaning of this paragraph immediately before the death of such individual shall continue to be considered a spouse of such individual after the death of such individual;

  • Members’ Percentage Interests means the ownership percentage interests as mentioned in Section I of this Agreement. During each fiscal year, the net profits and net losses of the Company (other than from capital transactions), and each item of income, gain, loss, deduction, or credit entering into the computation thereof, shall be credited or charged, as the case may be, to the capital accounts of each Member(s) in proportion to the Members' Percentage Interests. The net profits of the Company from capital transactions shall be allocated in the following order of priority: (a) to offset any negative balance in the capital accounts of the Member(s) in proportion to the amounts of the negative balance in their respective capital accounts, until all negative balances in the capital accounts have been eliminated; then (b) to the Member(s) in proportion to the Members’ Percentage Interests. The net losses of the Company from capital transactions shall be allocated in the following order of priority: (a) to the extent that the balance in the capital accounts of any Member(s) are in excess of their original contributions, to such Member(s) in proportion to the excess balances until all such excess balances have been reduced to zero; then (b) to the Member(s) in proportion to the Members’ Percentage Interests. The cash receipts of the Company shall be applied in the following order of priority: (a) to the payment of interest or amortization on any mortgages on the assets of the Company, amounts due on debts and liabilities of the Company other than those due to any Member(s), costs of the construction of the improvements to the assets of the Company and operating expenses of the Company; (b) to the payment of interest and establishment of cash reserves determined by the Member(s) to be necessary or appropriate, including without limitation, reserves for the operation of the Company’s business, construction, repairs, replacements, taxes and contingencies; and (d) to the repayment of any loans made to the Company by any Member(s). Thereafter, the cash receipts of the Company shall be distributed among the Member(s) as hereafter provided. Except as otherwise provided in this Agreement or otherwise required by law, distributions of cash receipts of the Company, other than from capital transactions, shall be allocated among the Member(s) in proportion to the Members’ Percentage Interests. Except as otherwise provided in this Agreement or otherwise required by law, distributions of cash receipts from capital transactions shall be allocated in the following order of priority: (a) to the Member(s) in proportion to their respective capital accounts until each Member(s) has received cash distributions equal to any positive balance in their capital account; then (b) to the Member(s) in proportion to the Members' Percentage Interests. It is the intention of the Member(s) that the allocations under this Agreement shall be deemed to have “substantial economic effect” within the meaning of Section 704 of the Internal Revenue Code and Treas. Reg. Section 1.704-1. Should the provisions of this Agreement be inconsistent with or in conflict with Section 704 of the Code or the Regulations thereunder, then Section 704 of the Code and the Regulations shall be deemed to override the contrary provisions thereof. If Section 704 of the Regulations at any time require that limited liability company operating agreements contain provisions which are not expressly set forth herein, such provisions shall be incorporated into this Agreement by reference and shall be deemed a part of this Agreement to the same extent as though they had been expressly set forth herein.

  • Class A Members means those Members who have purchased Class A Interests.

  • Member of the minor s family" means the minor's parent, stepparent, spouse, grandparent, brother, sister, uncle, or aunt, whether of the whole or half blood or by adoption.

  • Founding Members means those public school districts, cities, counties, and other governmental units that are signatories to the Joint Powers Agreement and have a voting member serving on the JPA's Board of Directors.

  • Percentage Interests shall have the meaning specified in the Trust Agreement.

  • Majority Participants means the Holder(s) of more than 50% of the Outstanding VMTP Shares.

  • Participating Class Members means all Class Members who do not submit valid

  • Preferred Member means a Member holding Preferred Units.

  • Members means all such Persons.

  • Parity Preferred Units shall have the meaning provided in Section 4.

  • Lead Member of the Bidding Consortium or “Lead Member” shall mean a company who commits at least 26% equity stake in the Project, meets the technical requirement as per Clause 2.1.2and so designated by other Member(s) in Bidding Consortium;

  • Unit Majority means (i) during the Subordination Period, at least a majority of the Outstanding Common Units (excluding Common Units owned by the General Partner and its Affiliates), voting as a class, and at least a majority of the Outstanding Subordinated Units, voting as a class, and (ii) after the end of the Subordination Period, at least a majority of the Outstanding Common Units.

  • Common Units is defined in the Partnership Agreement.

  • Teaching staff member means an employee who holds a position for which a certificate issued by the New Jersey State Board of Examiners is required.

  • Class A Member means a Member holding one or more Class A Ordinary Shares.

  • Member of the Board means an individual who is a member of the Board or of the board of directors of a Subsidiary or an Affiliate.

  • Partnership Interests shall have the meaning specified in Section 6.3 [Subsidiaries].

  • Common Interests of any Person means Capital Interests in such Person that do not rank prior, as to the payment of dividends or as to the distribution of assets upon any voluntary or involuntary liquidation, dissolution or winding up of such Person, to Capital Interests of any other class in such Person.

  • Member of the family shall have the meaning prescribed by Code Section 529(e)(2), and shall mean any individual who bears one of the following relationships to the beneficiary:

  • Unit Holders means all Unit Holders.

  • Common Unitholder means a Member who is the registered holder of Common Units.

  • Series A Preferred Units has the meaning assigned to such term in Section 5.11(a).

  • Member of the judge s family” means a spouse, domestic partner, child, grandchild, parent, grandparent, or other relative or person with whom the judge maintains a close familial relationship. See Rules 3.7, 3.8, 3.10, and 3.11.

  • ordinary member of the committee means a member of the committee who is not an officer of the Association under Rule 21;

  • Series B Preferred Units shall have the meaning provided in Section 1.
