If the summer job cannot be filled in the building or with a bargaining unit member, the position will be filled on a temporary basis for the duration of the summer program. 2. Probationary employees will be scheduled by management and may be assigned and rotated to any shift schedule. The Association recognizes that employee performance is of concern to management. As such, management retains the right to move an employee to a different squad and/or shift when it has reasonable cause to do so for training, supervision, and/or employee development. In such cases where another employee is displaced, this move will affect the least senior employee whenever possible. The Association also recognizes that with current staffing levels it is necessary to move employees to different shifts to facilitate vacation coverage, training, and other time off. Under the 5/4 work schedule this movement will be confined within the same squad as the person taking the time off, and such moves shall be made so as to minimize the change in shift starting times. Both parties acknowledge that a balance of experience on the respective squads can be critical to the Police Department’s overall efficiency. It is agreed that management, after reviewing the bids, has the right to make adjustments to the squad staffing, by reverse seniority, to achieve experiential balance. The above applies except in the following cases, for which management retains full authority and rights for assignment: • Special assignments (which currently includes, but is not limited to, detectives, SRO, crime prevention); • Hardships to any officer; • During times of emergency (as defined in section 30.6 of the current labor agreement). If, at any time during the year, an employee is moved from a non-patrol assignment, then that person shall be assigned to the squad/shift vacated by the employee’s replacement for the remainder of that year. If it is necessary for management to adjust the shift staffing levels or fill long term vacancies, other than those created by regular time off or reassignment of an employee, management shall fill those vacancies as follows: • Management shall ask for volunteers to fill the vacancies and award same based on seniority, except as noted above with regard to time limits for working the same shift and the status of probationary employees; • If volunteers are not available, management shall make the changes it deems necessary to assure adequate coverage for all shifts. Paraprofessionals from the specific classification where there are vacancies will be given priority consideration and be offered positions prior to staff from outside the classification and the bargaining unit. The summer job shall be offered to a bargaining unit member with a satisfactory evaluation. If given the summer position it will be as a temporary summer position. Work Schedule. Section A. This will provide a facility for the resting of squads engaged in lengthy or arduous fire fighting, oil spills, or other emergencies. This will also provide the opportunity for a fire fighter to rest or relax between watch duties providing that all required job responsibilities are fully met. The work week of the Administrative Captain, Operations Captain, Captain/Inspector and fire fighters detailed to the Training/Inspection Section shall be provided one (1) break period per day, normally about fifteen (15) minutes. In the event a year-round school program is developed and paraprofessional positions are available, representative(s) of LPS shall meet with LPA representative(s) to determine the proposed schedule for paraprofessional assignments, and to develop a posting(s) for such assignment(s). Paraprofessionals currently assigned to a work site where such a schedule is to occur shall be given the first opportunity to accept such an assignment.

Work Schedule. Section A. 15:02 Employees required by the Hospital to work in excess of the hours outlined in Article 15:01 herein shall be paid overtime for all such excess hours which shall be paid for at the rate of time and one-half the employee’s regular straight time rate of pay. The regular straight time rate of pay is that prescribed in wage Schedule “A” of the Collective Agreement.
15:03 Schedules shall be posted at least two (2) weeks in advance of going into effect. The work schedule encompassing Christmas and/or New Year will be posted by December 1st of each year.”
15:04 Schedules are to provide at least one (1) weekend off in three (3) weekends. Applies to 15:01 (a) only. The Hospital will endeavor to provide a schedule that provides employees with one weekend off in every two weekends.
15:05 Employees shall be paid time-and-one-half for all hours worked on Saturdays and allowed the trading of days off with another employee of their own status, subject to the approval of the immediate supervisor. Work Schedule. Section A. The normal regular workweek for department personnel shall average forty-two (42) hours.
B. The regular workweek for department personnel on the “platoon system” shall consist of two (2) consecutive days of ten (10) hours each, commencing at 0700 hours and concluding at 1700 hours, two (2) consecutive nights of fourteen (14) hours, commencing at 1700 hours and concluding at 0700 hours, followed by four (4) consecutive “days off”.
C. The District retains the rights of placing any firefighter hired after the institution of the Agreement (hereinafter designated as “new hirees”) on such a schedule they see fit to maintain adequate manpower, so long as the new hirees schedule does not exceed forty-two (42) hour workweek.
D. Deputy Chief and Fire Inspector shall work a forty (40) hour week scheduled between Monday and Friday for the typical workweek. The schedule shall be between the hours of 0700 – 1700 on a four (4) (ten (10) hour per day) schedule. The four (4) day schedule they work shall be an alternating schedule and not have the same scheduled day off. Section D. All overtime shall be divided as equally as possible between 25.04 Shift schedules for full-time employees and part-time shall provide the following:
(a) at least two (2) consecutive days of each building and/or department, according rest per week averaged over one (1) complete cycle of the shift schedule. Section F. Employees 25.05 All regular hours worked on a shift in violation of the provisions of Article 25.04 will be paid at the rate of one and one-half times (1 1/2X) the basic rate of pay.
(a) An Employee who volunteers or agrees to work additional shifts which are not designated as her scheduled days of rest, shall be paid timeat straight time rates for all hours worked up to seven point seven five (7.75) hours in a day and at two times (2X) her Basic rate of Pay for all hours worked in excess of seven point seven five (7.75) hours in a day.
(b) Where the Employer requires a Full-andtime or Part-one-half time Employee to work on her scheduled days of rest without her having volunteered or agreed to do so such Employee will have another day off scheduled immediately adjacent to her remaining day off or be paid two times (2X) her Basic Rate of Pay for all hours worked on Saturdays that day.
(a) The Employer shall endeavor to minimize the application of day/evening/night shift rotations within the facility.
(b) The shift patterns which may be available are:
(i) days, evenings, night rotations;
(ii) permanent days;
(iii) permanent evenings (only by request of Employee);
(iv) permanent nights (only by request of Employee);
(v) evening and days;
(vi) nights and evenings;
(vii) nights and days.
25.08 Those Employees working the last shift when the change from Daylight Saving to Standard Time occurs shall be paid double-time at the overtime rates for all the exact number of hours worked on Sundays and holidaysduring the shift in excess of seven point seven five (7.75) hours. Work Schedule. Section A. SECTION 1. The normal work schedule for most regular, full- time employees week shall be a maximum begin at 12:01 A.M. on Sunday and end at 12 midnight on Saturday. The work day shall consist of eight (8) hours a per day and a maximum of forty (40) hours per week, Monday through Friday, and a minimum of six (6) hours a day and thirty (30) hours a week provided nothing herein shall be construed as a guarantee of hours worked per day, or days worked per week. Para- professionals who are unless an employee is regularly scheduled to work less more than full time (less than six (6) hours) are expected to work their assigned hours. Employees may receive a meal period of one week(1) hour if consistent with operating efficiency and shall be scheduled by the Employer. In such case, forty-five (45) minutes of the meal period shall be unpaid and fifteen (15) minutes shall be paid in lieu of the two ten (10) minute rest periods mentioned in Section 3 of Article VI. The allowance employer shall have the sole discretion of an overtime premium on setting the duration of the meal period in accordance with the above minimum and maximum time periods. Employees who are required by their supervisors to be at their assigned station, or are required to attend a mandatory/required meeting, shall receive straight-time pay plus any hour excludes that hour from consideration applicable shift differential during the meal period. This time will be considered as time worked for overtime payment on any other basis, thus eliminating any double or pyramiding the computation of overtime paymentsovertime.
Section D. All overtime SECTION 3. Each employee shall receive a rest period during each continuous four (4) hours of work of not more than ten (10) minutes. Work Schedule. Section A. The normal work schedule workday for most regular, full- regular full-time employees shall be a maximum of eight (8) hours per day, exclusive of a duty-free lunch period, and the normal workweek shall be forty (40) hours. This provision shall not be construed as a limitation on the employer’s right to schedule hours less than or more than the normal work day and work week.
B. The regular workday and workweek set forth in Section A above may be modified by the Employer upon prior notification to and negotiations with the Union. Unless otherwise agreed to by the Union, a maximum reduction in the workday/week shall be treated as a partial layoff and governed by the provisions of Article X.A.
C. The number of days to be worked before and/or after the regular school calendar for less than twelve (12) month employees shall be as determined by the superintendent or someone designated by him. Pay shall be calculated for only those hours actually worked.
D. All secretaries shall be entitled to a duty-free lunch period. However, in circumstances in which an elementary school principal is absent for an entire day, the secretary in that building will not receive a duty-free lunch, but will be paid for that lunch period. In buildings where more than one secretary is assigned, lunch schedules will be staggered to ensure that a minimum of two (2) secretaries are present in the office at all times.
E. Pay for authorized overtime over forty (40) hours per week, Monday through Friday, and a minimum of six (6) hours a day and thirty (30) hours a week provided nothing herein shall be construed computed at time and one-half. Authorized overtime shall be defined as time worked in excess of the forty (40) hour week when requested by the employee's immediate supervisor. Double time - the employee's hourly rate will be paid for all work performance on Sundays and holidays.
F. Under normal circumstances all secretaries shall be entitled to a guarantee fifteen (15) minute relief period in the morning and in the afternoon.
G. Secretaries working 12 months may, in consultation with their immediate supervisor, elect a shorter lunch period during summer months in order to reduce the length of hours worked per their day.
H. When schools are closed to students and teachers due to cancellation of a scheduled student instruction day, or days worked per week. Para- professionals who are employees scheduled to work less than full time (less than six (6) hours) are expected on that day shall not be required to work their assigned hoursreport. Teachers are encouraged, but not obligated, to attend student programs. The administration shall be reasonable in the expectancy of teacher participation outside the normal workday, and in the length and frequency of such, and shall provide adequate notice prior to making such requests. If requested by administration and accepted by a teacher, and such time extensions that average more than two hours per month, such excess time shall be paid in paychecks on a pro- rated per diem basis three times per year (December, March, and June) or in trade time-and-one-half for all hours worked .

Work Schedule. Section A. 16.1 The regular work week for the Union shall not exceed forty-two (42) hours per week on an annual basis. The normal work schedule for most regular, full- time employees shall be a maximum of twenty-four (24) hours on duty, forty-eight (8) 48) hours off duty, twenty-four (24) hours on duty, and ninety-six (96) hours off duty.
16.2 The Town agrees not to change the work schedule during this contract except, in the case of an emergency, as declared by the Town Manager.
16.3 At such time as a day and firefighter may be assigned to work other than a maximum of regular work schedule, specifically a Monday through Friday, forty (40) hours per week schedule, that firefighter shall be entitled to all the benefits, terms and conditions as set forth within this Agreement, except as hereafter modified.
16.3.1 It shall be established that the weekly salary and accumulated hourly base pay shall continue to be the same as that which would apply for the normal weekly work schedule of forty- two (42) hours.
16.3.2 The Departments “Code 21” and “Leave” policies, shall not apply to those firefighters subject to this section.
16.3.3 Firefighters shall be given any Holiday, which falls within the forty (40) hour week, Monday through Friday, and off with no loss of pay in lieu of Holiday Pay (to be treated same as all 40 hour per week Town of Brunswick employees).
16.3.4 Overtime shall be paid at the same rate as provided within Article 21 of this Agreement.
16.4 Firefighters covered by this Agreement shall be entitled to a minimum of six (6) hours a day and thirty (30) hours minute break and a week provided nothing herein shall one and one half (1 ½) hour lunch. Section F. Employees 25.05 All regular hours worked on a shift in violation of the provisions of Article 25.04 will be paid at the rate of one and one-half times (1 1/2X) the Basic Rate of Pay.
(a) An Employee who volunteers or agrees to work additional shifts which are not designated as her scheduled days of rest, shall be paid timeat straight time rates for all hours worked up to seven point seven five (7.75) hours in a day and at two times (2X) her Basic Rate of Pay for all hours worked in excess of seven point seven five (7.75) hours in a day.
(b) Where the Employer requires a Full-andtime or Part-one-half time Employee to work on her scheduled days of rest without her having volunteered or agreed to do so such Employee will have another day off scheduled immediately adjacent to her remaining day off or be paid two times (2X) her basic rate of pay for all hours worked on Saturdays that day.
(a) The Employer shall endeavor to minimize the application of day/evening/night shift rotations within the facility.
(b) The shift patterns which may be available are:
(i) days, evenings, night rotations;
(ii) permanent days;
(iii) permanent evenings (only by request of Employee);
(iv) permanent nights (only by request of Employee);
(v) evening and days;
(vi) nights and evenings;
(vii) nights and days.
25.08 Those Employees working the last shift when the change from Daylight Saving to Standard Time occurs shall be paid double-time at the overtime rates for all the exact number of hours worked on Sundays and holidaysduring the shift in excess of seven point seven five (7.75) hours. Whenever possible, advance notice Employees working a shift of overtime less than seven point seven five (7.75) hours at the change from Standard Time to Daylight Saving Time shall be given so that necessary arrangements can be made.

In the event the duties attached to a ten-(10) month job are extended as part of a summer school program, or a separate summer school program is created, the person(s) with a satisfactory evaluation who hold the position that is in an extended summer school program or part of a K -12 General Education summer school program, shall continue to perform those assigned duties. If the regular employee in that position declines to work in the summer months, the position will be posted. Paraprofessionals from the specific classification where there are vacancies will be given priority consideration and be offered positions prior to staff from outside the classification and the bargaining unit. The summer job shall be offered to a bargaining unit member with a satisfactory evaluation. If given the summer position it will be as a temporary summer position. If the summer job cannot be filled in the building or with a bargaining unit member, the position will be filled on a temporary basis paid only for the duration of the summer programactual hours worked.
2. In the event a year-round school program is developed and paraprofessional positions are available, representative(s) of LPS shall meet with LPA representative(s) to determine the proposed schedule for paraprofessional assignments, and to develop a posting(s) for such assignment(s). Paraprofessionals currently assigned to a work site where such a schedule is to occur shall be given the first opportunity to accept such an assignment.
a. In the event a paraprofessional currently assigned to such a building does not wish to accept such an assignment, that position shall be posted internally, and the person currently holding the position shall be allowed to transfer to a vacant position.
b. If no vacancy exists, the paraprofessional currently holding the position shall be allowed to bump the least senior paraprofessional in his/her classification.
