Voluntary Curtailment Credits. EESI may from time to time request that thea Sysco PartiesParty voluntarily curtail theirits energy consumption at a certain FacilitiesFacility(ies) in exchange for a portion of the savings attributable to any such curtailment by the applicable Sysco CorporationParty (the "Sysco CorporationParty Curtailment Payment"). At the time of such request, EESI will indicate to the applicable Sysco PartiesParty the quantity of energy that EESI is requesting that such Sysco PartiesParty curtail and the amount of the Sysco CorporationParty Curtailment Payment. If the applicable Sysco PartiesParty in theirits sole discretion agreeagrees to so curtail theirits consumption at such Facilities in accordance with such request, and provided that the applicable Sysco Parties do in fact curtail such consumption in accordanceParty complies with suchthat requestagreement, (i) EESI will credit the applicable Sysco CorporationParty for the Sysco CorporationParty Curtailment Payment on the next EESI Invoice; and (ii) the applicable Sysco CorporationParty will receive a credit toward the Minimum Usage requirement hereunder (and against any Deficiency Usage) for each kWh of energy actually curtailed by the applicable Sysco PartiesParty pursuant to this Section 2.2.4. The applicable Sysco CorporationParty and EESI will cooperate to verify the quantity of energy curtailed by the applicable Sysco PartiesParty under this provision using fifteen (15) minute interval meter data from before and during any such curtailment. EESI will pay the cost of purchasing, installing and connecting any additional metering equipment necessary to compile the data contemplated by this Section.

Voluntary Curtailment Credits. Where EESI has exercised an EESI Energy Sales Option, EESI may from time to time request that Customer voluntarily curtail its Energy consumption at certain Facilities in exchange for a portion of the savings attributable to any such curtailment by Customer (the "Customer Curtailment Payment"). At the time of such request, EESI shall indicate to Customer the quantity of Energy (the "Customer Curtailment Quantity") that EESI is requesting that Customer curtail and the amount of the Customer Curtailment Payment. If Customer in its sole discretion agrees to so curtail its consumption at such Facilities in accordance with such request, and Customer does in fact so curtail such consumption, (i) EESI shall credit Customer for the Customer Curtailment Payment on the next EESI Invoice; and (ii) Customer shall receive a credit toward the Minimum Usage requirement hereunder (and against any Deficiency Usage) for each kWh of Energy actually curtailed by Customer pursuant to this Section 2.2.3. Customer and EESI shall cooperate to verify the quantity of Energy curtailed by Customer under this provision using fifteen (15) minute interval meter data from an agreed upon corresponding period during which there was no curtailment. To the extent that Customer curtails less than the agreed upon consumption (a "Curtailment Imbalance"), the Customer will receive an amount equal to (i) the full Customer Curtailment Payment minus (ii) an amount equal to (a) the Customer Curtailment Quantity minus Customer's actual consumption curtailment quantity multiplied by (b) the Spot Energy Price plus (c) any reasonable costs and imbalance penalties incurred by EESI as a result of the Curtailment Imbalance.
Voluntary Curtailment Credits. EESI may from time to time request that SBC voluntarily curtail its energy consumption at certain Facilities in exchange for a portion of the savings attributable to any such curtailment by SBC (the “SBC Curtailment Payment”). At the time of such request, EESI will indicate to SBC the quantity of energy that EESI is requesting that SBC curtail and the amount of the SBC Curtailment Payment. If SBC in its sole discretion agrees to so curtail its consumption at such Facilities in accordance with such request, and SBC does in fact curtail such consumption in accordance with such request, then (a) EESI will credit SBC for the SBC Curtailment Payment on the next EESI Invoice; and (b) SBC will receive a credit toward the Minimum Usage requirement hereunder (and against any Deficiency Usage) for each kWh of energy actually curtailed by SBC pursuant to this Section 2.2.4. SBC and EESI will cooperate to verify the quantity of energy curtailed by SBC under this provision using the best available (typically 15, 30, or 60 minute) interval meter data from before and during any such curtailment.
Voluntary Curtailment Credits. Where EESI is delivering energy directly to Customer in accordance with Schedule 1.0, EESI may from time to time request that Customer voluntarily curtail its energy consumption at certain Accounts in exchange for a portion of the savings attributable to any such curtailment by Customer (the "Customer Curtailment Payment"). At the time of such request, EESI shall indicate to Customer the quantity of energy that EESI is requesting that Customer curtail and the amount of the Customer Curtailment Payment. If Customer in its sole discretion agrees to so curtail its consumption at such Accounts in accordance with such request, EESI will confirm the quantity of energy to be curtailed and the Customer Curtailment Payment to Customer in writing. If Customer does in fact curtail such consumption in accordance with such request, (i) EESI shall credit Customer for the Customer Curtailment Payment on the next Billing Cycle; and (ii) Customer shall receive a credit toward the Minimum Usage requirement hereunder (and against any Deficiency Usage) for each kWh of energy actually curtailed by Customer pursuant to this Section 2.2.3. Customer and EESI shall cooperate to verify the quantity of energy curtailed by Customer under this provision using fifteen (15) minute interval meter data from before and during any such curtailment.

Related to Voluntary Curtailment Credits

  • Retirement Credit Retirement credit for such periods of leave without pay shall be governed by the rules and regulations of the Division of Retirement and the provisions of Chapter 121, Florida Statutes.

The Employer agrees to deduct from the wages of any employee who is a member of the Union a DRIVE and/or a Teamsters Legal Defense Fund deduction as provided for in a written authorization.   • Accrual Rate of Sick Leave With Pay Credits Full-time employees shall accrue eight (8) hours of sick leave with pay credits for each full month worked. Employees who work less than the full month but at least thirty-two (32) hours during the month shall accrue sick leave with pay on a pro rata basis for the month.

  • Billing Adjustment Credit To provide Customer the benefit of the rates and discounts in the Amendment as of the Effective Date and until such rates and discounts are implemented, the Company shall provide Customer with a one-time billing adjustment credit equal to $99,000.00, plus applicable taxes and surcharges. This credit shall compensate Customer for the difference between the Tariff/Guide/list rates invoiced during the 1st full billing cycle following Customer's signature date above and the rates and discounts in this Agreement.   • When Must Distributions from a Xxxxxxxxx Education Savings Account Begin? Distribution of a Xxxxxxxxx Education Savings Account must be made (or otherwise will be deemed made) no later than 30 days from the earlier of the beneficiary’s death or attainment of age 30. A distribution from a Xxxxxxxxx Education Savings Account may be rolled over to another beneficiary’s Xxxxxxxxx Education Savings Account according to the requirements of Section (4). Note that the Economic Growth and Tax Relief Reconciliation Act of 2001 waives the distribution age limitation if the beneficiary of the Xxxxxxxxx Education Savings Account is a “Special Needs” student.
