Common use of Unpaid Lunch Clause in Contracts

Unpaid Lunch. ‌ Custodial employees shall be permitted to leave premises during any unpaid lunch break provided custodians remain on site in sufficient numbers to ensure operation of the facility, and there is at least one custodian on duty at all times. In those cases where there is only one custodian on duty, and he/she cannot be provided with an uninterrupted lunch break on a given day, the employee shall be paid unless the lunch period can be rescheduled later on the same day. The employee may request to be compensated through compensatory time off upon the approval of the principal/administrator. If such workweek is in excess of a 40-hour workweek, the pay or compensatory time shall be paid at one and one half of the employee’s regular rate of pay.
