Transporter's Tariff. The rules, guidelines, and policies of the pipeline immediately downstream of the Delivery Point ("Transporter") shall define and set forth the manner in which the Committed Gas purchased and sold under this Agreement is measured and transported. CUSA and NGC recognize that the receipt and delivery into Transporter's pipeline facilities of Committed Gas purchased and sold under this Agreement shall be subject to the operational procedures of Transporter as well as the terms of Transporter's transportation service agreement(s) with NGC, if any, addressing operational procedures.

UPR shall designate on the relevant Availability Report the Transporter's Tariff that will apply to Split Connect Committed Gas; provided, however, that the Transporter so designated must have been selected by UPR in its designation of a Split Connect Index pursuant to Section 7.2(a).

  • Delivery Points The measurement of and tests for quality of Shipper's Gas redelivered at the Delivery Points shall be governed by and determined in accordance with the requirements of the receiving pipeline at each Delivery Point.

  • Delivery Point Once Manufacture of the Products has been completed, Contractor shall be responsible for delivering the Finished Goods FCA, (as defined in Incoterms (2000) published by the International Chamber of Commerce) and to a freight forwarder specified by Company in its Order, or otherwise approved by Company. “Delivery Point” as used in this Agreement shall mean the specific time and location that the Product is delivered to the shipper specified on the Order.

  • Storage Tanks If storage tanks storing Hazardous Materials located on the Premises or the Project are used by Tenant or are hereafter placed on the Premises or the Project by Tenant, Tenant shall install, use, monitor, operate, maintain, upgrade and manage such storage tanks, maintain appropriate records, obtain and maintain appropriate insurance, implement reporting procedures, properly close any storage tanks, and take or cause to be taken all other actions necessary or required under applicable state and federal Legal Requirements, as such now exists or may hereafter be adopted or amended in connection with the installation, use, maintenance, management, operation, upgrading and closure of such storage tanks. Notwithstanding anything to the contrary contained herein, Tenant shall have no right to use or install any underground storage tanks at the Project.
