Common use of Transfer and Seniority Outside Bargaining Units Clause in Contracts

Transfer and Seniority Outside Bargaining Units. No employee shall be transferred to a position not covered by the provisions of the collective agreement with the Ontario Nurses' Association without her or his consent. If an employee is so transferred, she or he shall retain her or his seniority acquired at the date of leaving the unit, but will not accumulate any further seniority. If such an employee later returns to a position covered by the provisions of the Collective Agreement with the Ontario Nurses' Association, she or he shall be placed in a job consistent with her or his seniority. Such return shall not result in layoff or bumping of an employee holding greater seniority.
