Tolling of Time Periods. In the event that a controversy or claim has been raised and is in the process of dispute resolution in accordance with Sections 12.2, 12.3 or 12.4, any applicable time period governing the underlying controversy or claim shall be tolled pending the outcome of the resolution process after which the time period shall again begin to run.
Tolling of Time Periods. Employee agrees that in the event Employee violates any subsection of Section 5 of this Agreement as to which there is a specific time period during which Employee is prohibited from certain actions and activities, such violation shall toll the running of such time period from the date of such violation until the date the violation ceases.

The parties hereto agree that the running of all statutes of limitation and the doctrine of laches applicable to all claims or causes of action that the Agent or any Lender may be entitled to take or bring to enforce its rights and remedies against you are, to the fullest extent permitted by law, tolled and suspended during the Forbearance Period.

In the event that Shareholder or the Seller violate the provisions of Section 8.1 or 8.2 of this Agreement, the Restrictive Period shall toll during any period of non-compliance, and shall not continue to elapse until Shareholder and the Seller is in full compliance with Section 8.1 and 8.2 of this Agreement.

In the event that the Company should bring any legal action or other proceedings for the enforcement of this Section 8, the time for calculating the term of the restrictions provided herein shall not include any period of time commencing with the filing of legal action or other proceeding to enforce the terms of this Section 8 through the date of final judgment or final resolution, including all appeals, if any, of such legal action or other proceeding, unless the Company fails to prevail in such action or proceeding.
Tolling of Time Periods. The time for calculating the term of the restrictions contained herein shall not include any period of time during which the covenant is violated or in which any legal action or other proceeding is ongoing to enforce the terms of this Agreement through the date of final judgment or final resolution, including all appeals, if any, of such legal action or other proceeding, unless the Brightstar Parties fail to prevail in such action or proceeding.
Tolling of Time Periods. The provisions of this Section 8.3 shall apply for the applicable periods as set forth above. If the Seller violates the restrictive covenant provisions set forth in this Section 8.3, and the Purchaser, any of the Purchaser’s successors and assigns or any of the Purchaser’s Affiliates brings legal action for injunctive or other relief, such party bringing the action shall not, as a result of the time involved in obtaining the relief, be deprived of the benefit of the full period of the restrictive covenant, unless a court of competent jurisdiction holds that the restrictive covenant is not enforceable in whole or in part. Accordingly, for any time period that the Seller is in violation of the restrictive covenant, such time period shall not be included in calculating the duration of the restrictive covenant indicated above.
Tolling of Time Periods. The ending date of the time periods set forth in section 10 of this agreement are to be tolled and suspended during any period in which Executive is in violation of this agreement so that the periods of noncompetition and nonsolicitation are extended by the number of days during which Executive was in violation of this agreement.

Tolling of Time Periods. If Colleague violates any restrictions under this Agreement, in addition to Energizer’s other rights and remedies, the time period of such violation(s) will not count toward satisfying the time during which such restriction(s) will apply.
