Termination for Failure to Pay Rent. If all or any portion of the rent is unpaid when due and Tenant fails to pay unpaid rent within five (5) days after written notice by Landlord of an intention to terminate Lease if rent is not so paid, Landlord may terminate the Lease. Landlord may also maintain an action for rent and/or damages without terminating the Lease.

Termination for Failure to Pay Rent. If any payment of Rent is not made as herein provided and such failure to pay is not cured within three (3) days after written notice thereof is served on the TENANT, CITY shall have the option to immediately terminate this Lease; and in the event of such termination, TENANT shall have no further right or claim thereto and CITY shall immediately thereupon have the right to re-enter and take possession of the Premises, subject only to appropriate legal process.
Termination for Failure to Pay Rent. If by April 1, 2019, Xxxxxx has not started paying full monthly Base Rent as outlined in 1(c) of $13,750.00, and the failure continues for five (5) days from when due, Landlord shall then have the right, upon sixty (60) days written notice to Tenant and subject to the cure rights in this Section, to terminate this Lease. During such sixty (60) day period, Tenant shall have the right to cure, by (i) depositing with Landlord the amount of $41,250.00, as a security deposit (ii) by remitting the missed Base Rent payment and (iii) continuing to pay Rent and all additional amounts due hereunder. Nothing in this subsection (d) shall limit Landlord’s default rights and remedies under Section 24.
