Common use of Special Day Clause in Contracts

Special Day. In addition to the holidays specified in this Article, all full-time employees shall receive eight (8) hours of paid leave. Part-time and job share employees shall receive prorated share of eight (8) hours of paid leave at their regular straight time rate of pay based upon the same percentage or fraction of month, as they are normally scheduled to work. Paid leave granted in this Section shall be accrued by all employees employed as of the day before Thanksgiving or Christmas of each year. Employees who are employed as of the day before Thanksgiving may request the option of using this paid leave on the workday before or after Thanksgiving, Christmas or New Year’s Day. Employees who become employed after Thanksgiving, but before Christmas may request the State option of using this paid leave on the workday before or after Christmas or the workday before or after New Year’s Day. If the employee chooses not to take one (1) of the aforementioned days, another day may be mutually agreed upon, provided such time is taken off by January 15th of the following year.

If the employee chooses , or, when these days are not available to take one (1) an employee, on another day of the aforementioned daysemployee’s choice; provided that, another day may approved usage of this leave shall be mutually agreed upon, provided such time is taken off by January 15th granted on a basis which shall preclude the closure of state facilities. Instead of the following yearday before or after New Years or Christmas, employees employed as of the day before Thanksgiving may choose to use the special day on the day before or the day after Thanksgiving.
