Sharing of Facilities. 8 (1) This paragraph applies where co-operation between the HIU and the Police Service takes the form of the Police Service making facilities available for use by the HIU.

Notwithstanding the foregoing, the Lessee may share Severable Modifications or certain facilities including, without limitation, substation, interconnection and transmission facilities, back-up generators, emergency equipment and administrative facilities, for the Phase II Project, so long as (i) any construction is conducted by entities other than the Lessee Partners or the Lessee, (ii) with respect to the Severable Modifications, the Lessee shall comply with Section 11.1 hereto and Section 8 of the Project Lease, and (iii) any such sharing shall not reduce by more than a de minimis amount, the rights and benefits of the Owner Lessor, and, so long as the Lien of the Indenture shall not have been terminated and fully discharged, the Indenture Trustee, with respect to the Project or adversely affect the ability of the Project to generate and transmit power to the limit of 33 MW, therefrom.
