Sale in Lieu of Condemnation. Sale of all or part of the Premises to a purchaser with the power of eminent domain in the face of a threat or probability of the exercise of the power shall be treated for the purposes of this Section 9 as a taking by condemnation.
Sale in Lieu of Condemnation. A voluntary sale by Landlord of all or any part of the Property to any public or quasi-public body, agency or person, corporate or otherwise, having the power of eminent domain, either under threat of condemnation or while condemnation proceedings are pending, shall be deemed to be a taking under the power of eminent domain for the purposes of this Article.
Sale in Lieu of Condemnation. In the event of a negotiated sale of all or a portion of the Premises in lieu of condemnation, the proceeds shall be distributed as provided in cases of condemnation as provided in Section 9.04 above.
Sale in Lieu of Condemnation. Sale of all or a part of the Premises or Building to a purchaser with the power of eminent domain in the face of a threat, or the probability of the exercise of the power, will be treated as a taking by condemnation.
Sale in Lieu of Condemnation. For purposes of this Lease, a taking by a condemning authority shall include any purchase or other acquisition in lieu of condemnation.
Sale in Lieu of Condemnation. Sale of all or part of the Premises by Landlord to a purchaser with the power of eminent domain in the face of a threat or probability of the exercise of the power shall be treated for the purposes of this Section 14 as a taking by condemnation, and Landlord shall reimburse in full all tax increment financing provided through the Missoula Redevelopment Agency, described under Section 11.a
Sale in Lieu of Condemnation. IAT shall not sell, assign, or otherwise transfer, (or agree to do so) any interest in Terminal 4 to any Governmental Authority or the Port Authority in lieu of or anticipation of any condemnation or exercise of the power of eminent domain without the consent of Delta. Any such sale, assignment or other transfer (or agreement to do so) in lieu or anticipation of any condemnation or exercise of the power of eminent domain shall be treated as a condemnation or exercise of the power of the eminent domain under this Article 22.
Sale in Lieu of Condemnation. For the purposes of this Section 16, a voluntary sale or conveyance in lieu of condemnation shall be deemed an appropriation or taking under the power of eminent domain.
Sale in Lieu of Condemnation. For the purposes of this Article X the voluntary sale or conveyance in lieu of condemnation, or transfer of all or a portion of the Building in avoidance of condemnation, hut under a threat of condemnation, shall be deemed an appropriate caking under the power of eminent domain.
Sale in Lieu of Condemnation. Sale of all or part of the Premises to a purchaser with the power of eminent domain in the face of a threat or probability of the exercise of the power shall be treated for the purposes of this Section 13 as a taking by condemnation. Any sale as contemplated in this Section 13.3 shall require the consent of Lessee, such consent shall not be unreasonably withheld.
