Common use of Safe Vehicles Clause in Contracts

Safe Vehicles. No Employee shall be disciplined for refusing to drive an unsafe vehicle nor shall any employees be required to drive a vehicle that has not been determined to be safe.

Safe Vehicles. No Employee employee shall be disciplined for refusing to drive an unsafe vehicle nor shall any employees employee be required to drive a vehicle bus that has not been determined by the maintenance department to be safe, nor shall any employee be required to transport a passenger in a mobility assistance device unless the proper number of escarpment straps or devices, as determined by the Company, are provided in the vehicle.

The Employer shall not require Employees to take out of park and drive any vehicle that has is not been determined in safe operating condition. It shall not be a violation of this agreement or the basis for discipline where Employees refuse to be safeoperate such equipment unless such refusal is unjustified.
