S ubcontracts. The Contractor or subcontractor shall insert in any subcontracts the clauses set forth in paragraph (1) through (4) of this section and also a clause requiring the subcontractors to include these clauses in any lower tier subcontracts. The prime Contractor shall be responsible for compliance by any subcontractor or lower tier subcontractor with the clauses set forth in paragraphs (1) through (4) of this section.
S ubcontracts. In addition to the requirements set forth in Section 3.2, each Subcontract that Contractor executes for the performance of the TTMS Work will:
S ubcontracts. If Provider has any arrangements, in accordance with the terms of the Agreement, with affiliates, subsidiaries or any other subcontractors, directly or through another person or entity, to perform any of the services Provider is obligated to perform under the Agreement that are the subject of this Attachment, Provider will ensure that all such arrangements are in writing, duly executed and include all the terms contained in this Attachment. Provider will provide proof of such to Plan upon request. Provider further agrees to promptly amend its agreements with subcontractors, in the manner requested by Plan, to meet any additional CMS requirements that may apply to the services.
S ubcontracts. The Contractor shall sublet no part of the work without the consent of the Engineer, but such consent will not relieve the Contractor of the responsibility under the terms of his contract.
S ubcontracts. Every subcontract for any portion of the Work shall contain an obligation by the Subcontractor equal in effect to this Article.
S ubcontracts. The Contractor shall perform all of the Services with its own full time appropriately qualified, trained and experienced staff except that the Contractor may, with the prior written consent of the University, enter into written subcontract(s) for the performance of certain Services requiring proprietary knowledge of an original equipment manufacturer, electrical work and utilization of lift or access equipment. The Contractor shall be responsible for payment of all subcontractors and secondary suppliers. The Contractor shall be fully responsible for all work performed under this Agreement whether by the Contractor or its subcontractor or secondary suppliers.
S ubcontracts. Subcontractors shall be qualified and experienced in the type of Work they will be performing. Owner shall have the right to reject any subcontractor, but such right shall not relieve the responsibility of the Contractor for Contractor’s Work and the Work of the subcontractors. Contractor expressly assumes such responsibility and liability. Contractor shall enforce safety procedures, strict discipline, and good order among persons performing the Work.
S ubcontracts. The Service Provider shall, upon the District’s request, provide (i) a list of all Subcontractors and (ii) a copy of each contract related to the performance under the Agreement with each such Subcontractor. All subcontracts entered into by the Service Provider in connection with the Agreement shall comply with all applicable Laws, shall provide that they are governed by the laws of the State of Colorado, and shall be subject to all provisions of the Agreement.
