RIGHTS AND OBLIGATIONS OF THE AUTHORITY. Notwithstanding any provision hereof to the contrary, in view of the assignment, allocation and delegation by the Tribe to the Authority of this Agreement pursuant to the terms of the Authority Statute, the Parties confirm that all rights, title, interest, duties and obligations of the Tribe hereunder are and shall be construed and interpreted as rights, title, interest, duties and obligations of the Authority; provided that, notwithstanding such assignment, the Tribe shall remain liable for the performance of its obligations hereunder and such assignment shall not constitute a novation of the Tribe with respect to such obligations.
