Definition of Gross Receipts. As used in this Section, the term “TENANT” shall include TENANT, its agents, subtenants, licensees, or any person or entity acting under contract or agreement with TENANT and employees at off-site locations renting cars to Airport customers located within the Rental Car Radius or from FBO leaseholds. The term “gross receipts” shall include any and all charges invoiced or collected by TENANT, or monetary or non-monetary consideration received by TENANT, resulting from any and all services provided by TENANT or items sold, leased or rented by TENANT at, on, or about the Airport, unless expressly excluded, including but not limited to the following:

Definition of Gross Receipts. The term "Gross Receipts" as used herein shall mean the total amount of all receipts received or realized by, or accruing to the Contractor or on behalf of the Contractor from all cash or credit sales by the Contractor of services, materials, or other merchandise made pursuant to the privileges authorized by this Contract including, but not limited to: 1) Stand Due Fees, 2) Access Fees, and 3) other receipts received from fuel sales, taxicab vehicle sales, taxicab vehicle financing, taxicab vehicle rentals, equipment rentals, taxicab vehicle repair, service and maintenance revenue, and other services provided to taxicab operators and Contractor employees under the Contract. The Contractor shall also include in its Gross Receipts those receipts, derived by any companies affiliated with the Contractor providing services to Flyer taxicab operators, including, but not limited to, taxicab vehicle rentals, equipment rentals, and taxicab vehicle maintenance and repair services. A sale shall be deemed made by the Contractor if the merchandise or services are ordered from or through the Contractor for use under this Contract. All revenue shall be deemed to be received at the time of determination of the amount due the Contractor for each transaction, whether for cash or credit, and not at the time of billing or payment, unless otherwise specifically stated in this Contract.

Definition of Gross Receipts. Gross Receipts" for purposes herein shall mean and include the total actual gross charges for all food, beverages, services (including service charges in lieu of gratuities) and other products and services sold to customers of the Restaurant, for cash or credit, regardless of whether or not such sales are made from the premises of the Restaurant or any other location. Excluded from Gross Receipts are sales, use, service or excise taxes collected from customers and paid to the appropriate taxing authority, customer refunds, discounts and adjustments, employee discounts and proceeds from vending machine sales for newspapers and pay telephones.

Gross Receipts shall be broadly construed and shall include all revenue/consideration Contractor collects from pay-for-use transactions, advertising and sponsorship revenue, monthly subscription and roaming session fees and all other payments including, but not limited to, fees arising from contractual services provided by Contractor to Airports Authority tenants, concessionaires, and other Airports Authority approved operators at the Airports, any other revenue Contractor collects associated with consumer use of the Wi-Fi Platform and revenues Contractor receives from subscription account access to premium Wi-Fi Platform services. All revenues shall be deemed to be received at the time of the determination of the amount due to Contractor for each transaction, whether for cash or credit and not at the time of billing or payment, unless specifically approved by the Airports Authority. Gross Receipts shall exclude amounts of any federal, state, or municipal sales or similar taxes collected by Contractor.
