Review of Publication. As soon as is practicable prior to the oral public disclosure, and prior to the submission to any outside person for publication of a manuscript describing the scientific data resulting from any stage of the Early Stage Development Program or Later Stage Clinical Development, Introgen or RPRP, as the case may be, shall disclose to the Development Committee the disclosure or manuscript to be made or submitted, and shall allow the Development Committee at least thirty (30) days to determine whether such disclosure or manuscript contains subject matter for which patent protection should be sought prior to publication or which the other believes should be modified to avoid necessary regulatory or commercial difficulties. With respect to publications by investigators or other third parties, such publications shall be subject to review by the Development Committee under this Section 2.5 to the extent that Introgen or RPRP (as the case may be) has the right to do so.

Xxxxxxx shall be free to publish without such review any marketing or commercial materials related to Licensed Components or Licensed Products, as well as any scientific data generated by or on behalf of Xxxxxxx in connection with Commercialization, provided that any materials containing previously unpublished data from Clinical Studies including an MVA-BN Vector is subject to the prior review of BN in accordance with this Section.
Review of Publication. For scientific data resulting from the Research Program or the Development Program which the Steering Committee has approved in principle should be published, the party who produced such results shall have the right to publish the same in accordance with this Section 5.2. The Steering Committee shall approve (with or without conditions) or disapprove any such publication within thirty (30) days of a request to do so, taking into consideration the commercial and competitive consequences of such publication; and if the Steering Committee fails to so approve or disapprove within such period (other than due to an action or inaction of the party proposing such publication), the publication shall be deemed approved.

With respect to publications by investigators or other third parties, such publications shall be subject to review by the STEERING COMMITTEE under this Section to the extent that AvP or CRUCELL (as the case may be) has the right to do so.

Neither Party shall have the right to publish or present any Confidential Information of the other Party, except as provided in Section 9.2. After the Research Program Term, each Party and its Affiliates may publish or present results, data or scientific findings of any of their activities without the prior review of the other Party, provided that such publication or presentation does not disclose any of the other Party’s Confidential Information. Nothing contained in this Section 9.3 shall prohibit the inclusion of information necessary for a patent application; provided that the non-filing Party is given a reasonable opportunity to review the information to be included prior to submission of such patent application in accordance with Section 8.2. Nothing contained in this Section 9.3 shall prohibit either Party from disclosing the results, data or scientific findings of any activity performed by the other Party or its Affiliates pursuant to this Agreement without prior review and prior written consent of the other Party, where required, as reasonably determined by the disclosing Party’s legal counsel, by applicable law; provided that if a Party is required by law to make any such disclosure, to the extent it may legally do so, it will give reasonable advance notice to the other Party of such disclosure and will use its reasonable efforts to secure confidential treatment of such information prior to its disclosure (whether through protective orders or otherwise).

  • Advertising and Publicity No Credit Party shall issue or disseminate to the public (by advertisement, including without limitation any “tombstone” advertisement, press release or otherwise), submit for publication or otherwise cause or seek to publish any information describing the credit or other financial accommodations made available by the Lenders pursuant to this Agreement and the other Loan Documents without the prior written consent of the Administrative Agent.
