Common use of Review of Personnel Files Clause in Contracts

Review of Personnel Files. Bargaining unit members or their representatives authorized in writing shall be allowed to review their personnel files and all other files or documents maintained by the University Police Division, other than alleged criminal investigation records, that contain “personal information” on the member (as defined by Ohio Revised Code section 1347.01) unless the information is required by law to be kept confidential. Such review may be conducted at any reasonable time upon written request to and in the presence of the Chief of Police or designee. Except for supervisory and administrative personnel with a legitimate need to know, or in response to a valid and proper subpoena, no information in a member's personnel file or other personal information will be disclosed to anyone outside of the University, except for name, place of employment, dates of employment, job classification and pay range, unless a bargaining unit member requests in writing in advance to the University that specific data be provided. However, if a request is made to inspect or copy records within a member's personnel file or other personal information pursuant to open records provisions of the Ohio Revised Code, the University shall make all reasonable efforts to provide notification to the member of the nature of the request and provide the member at least five (5) calendar days prior to the University’s intended compliance therewith. Within that period, the member shall have the opportunity to take any one of the following actions:
