Recovering Creditor’s rights. (a) Any amount paid by a Creditor (a “Recovering Creditor”) to the Security Agent under Clause 8 (Effect of Insolvency Event) or Clause 9 (Turnover of Receipts) shall be treated as having been paid by the relevant Debtor and distributed to the Security Agent, the other Agents and the other Primary Creditors (each a “Sharing Creditor”) in accordance with the terms of this Agreement.
Recovering Creditor’s rights. (a) Any amount paid or distributed by a Creditor (a “Recovering Creditor”) to the Common Security Agent under Clause 12 (Effect of Insolvency Event) or Clause 13 (Turnover of receipts) shall be treated as having been paid or distributed by the relevant Debtor and shall be applied by the Common Security Agent in accordance with Clause 19 (Application of proceeds).
Recovering Creditor’s rights. (a) Any amount paid or distributed by a Creditor (a “Recovering Creditor”) to the Collateral Agent under Clause 4 (Effect of Insolvency Event) or Clause 5 (Turnover of Receipts) shall be treated as having been paid or distributed by the relevant Debtor and shall be applied by the Collateral Agent in accordance with Clause 12 (Application of Proceeds).
Recovering Creditor’s rights. (a) On a distribution by the Security Agent under paragraph 29.2 (Redistribution of payments), the Recovering Creditor will be subrogated to the rights of the Secured Parties which have shared in the redistribution.
Recovering Creditor’s rights. (a) Any amount paid by a Creditor or, as the case may be, an Intra-Group Lender (a “Recovering Creditor”) to the Security Agent under Clause 4 (Effect of Insolvency Event) or Clause 5 (Turnover of Receipts) shall be treated as having been paid by the relevant Debtor (or, if applicable, the relevant Security Provider) and distributed to the Security Agent, Creditors, Intra-Group Lenders, Noteholder Trustees and Noteholders (each a “Sharing Creditor”) in accordance with the terms of this Agreement.
Recovering Creditor’s rights. (A) Any amount paid by a Finance Party (a “Recovering Finance Party”) to the Security and Intercreditor Agent under Clause 4 (EFFECT OF INSOLVENCY EVENT) or Clause 5 (TURNOVER OF RECEIPTS) shall be treated as having been paid by the relevant Obligor and distributed to the Finance Parties (each a “Sharing Finance Party”) in accordance with the terms of this Agreement.
Recovering Creditor’s rights. 37.1.1 Any amount paid by a Creditor (a “Recovering Creditor”) to the Security Trustee under Clause 35 (Effect of Insolvency Event) or 36 (Turnover of Receipts) shall be treated as having been paid by the Borrower and distributed in accordance with the terms of this Agreement.
Recovering Creditor’s rights. (a) Any amount paid by a Creditor (a “Recovering Creditor”) to the Security Agent under Section 10 or Section 11 shall be treated as having been paid by the relevant Debtor and distributed to the Security Agent, the Representatives and the Primary Creditors (each a “Sharing Creditor”) in accordance with the terms of this Agreement.
Recovering Creditor’s rights. 24.3.1 On a distribution by the Security Agent under Clause 24.2 (Redistribution of payments), the Recovering Creditor will be subrogated to the rights of the Senior Secured Parties, Unsecured Senior Notes Finance Parties, Unsecured Senior Noteholders, the High Yield Notes Finance Parties and High Yield Noteholders which have shared in the redistribution.
Recovering Creditor’s rights. (a) Any amount paid by a Creditor (a “Recovering Creditor”) to the Security Trustee or the TI Bond Facility Administrative Agent under Clause 8 or Clause 9 shall be treated as having been paid by the relevant Obligor and distributed to the Security Trustee, Agents, Mandated Lead Arrangers and Senior Creditors, or, as applicable, the TI Bond Facility Administrative Agent and TI Bond Facility Creditors (each a “Sharing Creditor”) in accordance with the terms of this Agreement.
