PUBLICATION AND CONFIDENTIALITY PROCEDURES. 6.1 Subject to Clauses 6.4 and 6.5, each Party will use all reasonable endeavours not to disclose to any third party any Confidential Information nor use for any purpose except as expressly permitted by this Subaward, any of another Party’s Confidential Information.

No Party shall incur any obligation under clause 4.1 with respect to information Which: is known to the receiving Party before the start of the Project Period, and not impressed already with any obligation of confident iality to the disclosing Party; . or is or becomes publicly known without the fault of the receiving Party; or
PUBLICATION AND CONFIDENTIALITY PROCEDURES. 4.1 Subject to Clauses 4.4 and 4.7, each Party will use all reasonable endeavours not to disclose to any third party any Confidential Information nor use for any purpose except as expressly permitted by this Consortium Agreement, any of another Party’s Confidential Information. Notwithstanding the foregoing, the Parties agree that the Lead University may disclose other Parties' Confidential Information to third party members of the Executive Group for the sole purpose of the Project and subject to those third parties first being bound under provisions of confidentiality that are no less stringent than those contained in this Clause 4.
