Preauthorized Transfers You may arrange for deposits to be made to your Deposit Account(s) automatically when certain scheduled, recurring payments are received by us. You may arrange this service for such payments as Social Security payments, pension and annuity payments, compensation payments from your employer, or other recurring payments. You may also authorize us to make scheduled, reoccurring payments out of your checking or other transaction account to pay various individuals and organizations (like premium payments to your insurance company). Bill Pay is also available if you choose to activate this portion of Online Banking. By using Bill Pay, you authorize an electronic fund transfer from your checking account. This transaction is covered by Regulation E, and it is covered by the Electronic Fund Transfer Disclosure & Agreement. Call us at any location to find out how to arrange these services. See section number 7, for information on stopping preauthorized payments. To find out if a scheduled deposit has been made, see section number 2. ELECTRONIC CHECK CONVERSION/ELECTRONIC RETURNED CHECK FEES If you pay for purchases or bills with a check or draft, you may authorize your check or draft to be converted to an electronic funds transfer. You may also authorize merchants or other payees to electronically debit your account for returned check fees. Also, if your statement shows transfers that you did not make, including those made by card, code or other means, TELL US AT ONCE. You should also call the number or write to the address on the front of this booklet if you believe a transfer has been made using the information from your check without your permission BILLING ERRORS In case of errors or questions about an electronic funds transfer(s) from your account(s) or if you need more information about a transfer on the statements or receipt, please contact us at the address or phone number on the front of this booklet.

Liability for Failure to Stop Payment of Preauthorized Transfers If you order us to stop payment of a preauthorized transfer three (3) business days or more before the transfer is scheduled and we do not do so, we will be liable for your losses or damages.

SMALL BUSINESS PARTICIPATION AND DVBE PARTICIPATION REPORTING REQUIREMENTS a. If for this Contract Contractor made a commitment to achieve small business participation, then Contractor must within 60 days of receiving final payment under this Contract (or within such other time period as may be specified elsewhere in this Contract) report to the awarding department the actual percentage of small business participation that was achieved. (Govt. Code § 14841.)
Electronic Funds Transfers By signing the Account Card, completing and transmitting an online account card or service request, or signing or using the Visa Debit Card, or Home Banking service you agree to the following terms governing your and our rights and responsibilities concerning the electronic funds transfer services, as applicable. Terms and conditions set forth elsewhere in this Agreement shall also apply to your electronic funds transfer service. Electronic funds transfers ("EFTs") are electronically initiated transfers of money through direct deposits, automated teller machines ("ATMs"), point of sale transactions, debit card purchases, audio response transactions and online transactions involving your deposit accounts at the Credit Union.
Right to Request and Act on Instructions Agent may at any time request instructions from Lenders with respect to any actions or approvals which by the terms of this Agreement or of any of the Financing Documents Agent is permitted or desires to take or to grant, and if such instructions are promptly requested, Agent shall be absolutely entitled to refrain from taking any action or to withhold any approval and shall not be under any liability whatsoever to any Person for refraining from any action or withholding any approval under any of the Financing Documents until it shall have received such instructions from Required Lenders or all or such other portion of the Lenders as shall be prescribed by this Agreement. Without limiting the foregoing, no Lender shall have any right of action whatsoever against Agent as a result of Agent acting or refraining from acting under this Agreement or any of the other Financing Documents in accordance with the instructions of Required Lenders (or all or such other portion of the Lenders as shall be prescribed by this Agreement) and, notwithstanding the instructions of Required Lenders (or such other applicable portion of the Lenders), Agent shall have no obligation to take any action if it believes, in good faith, that such action would violate applicable Law or exposes Agent to any liability for which it has not received satisfactory indemnification in accordance with the provisions of Section 11.6.
Multiple Originals This Agreement may be executed on two or more counterparts, each of which when so executed shall be deemed to be an original, but such counterparts shall together constitute but one and the same instrument.
