Placing Faculty on Compulsory Leave Clause Samples
The "Placing Faculty on Compulsory Leave" clause authorizes an institution to require a faculty member to take a leave of absence under certain circumstances. Typically, this clause outlines the conditions that may trigger compulsory leave, such as ongoing investigations, health concerns, or other situations where the faculty member's presence may disrupt normal operations. Placing Faculty on Compulsory Leave a. If a Faculty Member is unable to perform assigned duties due to illness/injury or may pose a health risk to the University community, the President or representative may require the Faculty Member to submit to a medical examination, the results of which will be released to the University, by a health care provider chosen and paid by the University, or by a health care provider chosen and paid by the Faculty Member, who is acceptable to the President or representative. Such health care provider will submit the appropriate medical certification(s) to the University.
b. If the University agrees to accept the Faculty Member’s choice of a health care provider, the University may not then require another University-paid examination.
c. If the medical examination confirms that the Faculty Member is unable to perform assigned duties, the President or representative will place the Faculty Member on compulsory leave.
