Other Additional Vessels. In the case of any Additional Vessel except for the APMM Vessels, if the Manager has sufficient time prior to the normally scheduled dry-docking after such Additional Vessel’s acquisition to accrue the Dry-docking Allocation from the Technical Services Fees to be paid for such Additional Vessel in an amount sufficient to cover the costs of the normally scheduled dry-docking, then the refund mechanism in Section 3.5(b) above shall apply if this Agreement is terminated for any reason or expires, or the Manager otherwise ceases to manage such Additional Vessel under this Agreement, prior to the carrying out of such dry-docking. For any Additional Vessel except for the APMM Vessels, if the Manager has already paid the costs associated with the normally scheduled dry-docking after such Additional Vessel’s acquisition prior to the Manager having sufficient time to accrue the Dry-docking Allocation from the Technical Services Fee paid in an amount sufficient to cover the costs of the normally scheduled dry-docking, then the reimbursement mechanism in Section 3.5(c) above shall apply if this Agreement is terminated for any reason or expires, or the Manager otherwise ceases to manage such Additional Vessel under this Agreement, prior to the carrying out of such dry-docking.

Any security interest in the leased equipment, goods or property granted to the Contractor contrary to AGO 79-72 and AGO 80-9 is null and void. Limitations of remedies provisions, which are unconscionable under applicable Florida law, are void. MATERIAL SAFETY DATA SHEET (MSDS). In compliance with Florida Statutes, Ch. 442, a Material Safety Data Sheet (MSDS) must accompany any applicable item delivered under this Agreement.

  • Insurances 27.1 Without limiting the liability of the Supplier/Service Provider under this Agreement, the Supplier/Service Provider shall take out insurance in respect of all risks for which it is prudent for the Supplier/Service Provider to insure against, including any liability it may have as a result of its activities under this Agreement for theft, destruction, death or injury to any person and damage to property. The level of insurance will be kept under review by Transnet, on an annual basis, to ensure its adequacy, provided that any variation to the level of such insurance shall be entirely at the discretion of the Supplier/Service Provider.
