Obligations of the Services. Upon execution of this agreement by all parties, and satisfaction of all other applicable legal requirements, the Services will issue to the City a permit under section 10(a)(1)(B) of the ESA, authorizing incidental take of each listed covered species resulting from covered activities on covered lands. The permit will be conditioned on compliance with all terms and conditions of the HCP, and this agreement, in all respects material to achieving the conservation objectives of the HCP.
Obligations of the Services. The Services shall perform the following duties to the extent permitted by the ESA and other applicable federal law.

Upon execution of this Agreement by all parties, and satisfaction of all other applicable legal requirements, the Services will each issue Permittee a permit under Section 10(a)(1)(B) of the ESA, authorizing incidental take by Permittee of the listed fish and wildlife covered species under the jurisdiction of the respective Service resulting from covered activities within the Plan Area. Because take of listed plant species is not prohibited under the federal ESA and therefore is not authorized under the FWS Section 10(a)(1)(B) permit, the Yreka phlox is listed on the FWS Section 10(a)(1)(B) permit in recognition of the conservation measures and benefits provided for this plant species under the HCP. Any reference in this Agreement or in the HCP to incidental take or take of covered species shall, for the purpose of incidental take authorized under the FWS Section 10(a)(1)(B) permit, refer solely to species on the covered species list other than the Yreka phlox.
Obligations of the Services. (a) Upon execution of this Agreement, the Services will issue the ITP to Green Diamond under Section 10(a)(1)(B) of the ESA. The ITP will authorize the incidental take by Green Diamond of each Covered Species resulting from Covered Activities on the Tree Farm provided, that as to any Covered Species which is not listed as “threatened” or “endangered” under the ESA as of the date of this Agreement, the ITP shall automatically become effective at such time as such species is listed as “threatened” or “endangered” under the ESA.
Obligations of the Services. The Services will fully and faithfully perform all obligations required of them under this Agreement, the NFHCP, and the Permits. In particular, upon execution of this Agreement by all parties, and satisfaction of all other applicable legal requirements, the Services will issue Plum Creek the Permits, authorizing current and future Take by Plum Creek of each Covered Species that may be Listed from time to time, incidental to Covered Activities.
