Notice of termination after expiration. In the event this Agreement expires and the Union and the Home have not agreed upon the terms and provisions of a new agreement, the Union shall not initiate, condone or participate in any strike, slowdown or other work stoppage without first giving the Home written notice at least ten (10) days in advance as to the date and time any such strike, slowdown or other work stoppage will commence. The Union shall be liable for any damages, liabilities, expenses or other costs incurred by the Home or any of its officers, board members or employees arising because of the Union’s failure to give such notice. This Section 2 shall remain in effect notwithstanding the expiration of the other provisions of this Agreement.

If TIPS terminates this Agreement for cause, and it is later determined that the termination for cause was wrongful, the termination shall automatically be converted to and treated as a termination for convenience.
