A Nonrecourse Lease clause establishes that the lessor’s recourse for payment or performance defaults is limited solely to the leased asset itself, rather than extending to the lessee’s other assets or personal guarantees. In practice, if the lessee fails to meet their obligations, the lessor can repossess the leased property but cannot pursue the lessee for additional compensation beyond the asset’s value. This clause primarily serves to allocate risk by protecting the lessee from broader financial liability, while ensuring the lessor’s remedy is confined to the leased item.
Nonrecourse Lease. Tenant shall look only to Landlord’s estate and property in the Land and the Building (or the proceeds thereof) for the satisfaction of Tenant’s remedies for the collection of a judgment (or other judicial process) requiring the payment of money by Landlord in the event of any default by Landlord hereunder, and no other property or assets of Landlord or its partners or principals, disclosed or undisclosed, shall be subject to levy, execution or other enforcement procedure for the satisfaction of Tenant’s remedies under or with respect to this Lease.

Notwithstanding anything to the contrary contained herein, Master Lessor shall not be liable in any way or to any extent to Tenant under this Lease, including but not limited to in connection with any breach by Landlord hereunder.
Nonrecourse Lease. Tenant and all successors and assigns acknowledge that, in the event of any actual or alleged failure, breach or default hereunder by Landlord: (a) the sole and exclusive remedy shall be a claim against the Landlord, with any judgment against Landlord being satisfied only out of its interest in the Building (no other assets of Landlord shall be subject to levy, execution or other procedure to satisfy such a judgment); (b) no Protected Party other than Landlord shall be sued, named as a party in any suit or action, served with process or subjected to any judgment, and any such judgment taken against any Protected Party other than Landlord may be vacated and set aside at any time nunc pro tunc; and (c) no writ of execution will ever by levied against the assets of any Protected Party other than Landlord.

Nonrecourse Lease. Tenant shall look only to Port’s estate in the Premises (or the proceeds thereof) for the satisfaction of Tenant’s remedies for the collection of a judgment (or other judicial process) requiring the payment of money by Port in the event of any default by Port hereunder, and no other property or assets of Port or its agents or officers, disclosed or undisclosed, shall be subject to levy, execution or other enforcement procedure for the satisfaction of Tenant’s remedies under or with respect to this Lease, the relationship of Port and Tenant hereunder or Tenant’s use or occupancy of the Premises and/or Building.
