Merchantable Quality Sample Clauses

Merchantable Quality. 13.1 Where under any legislation there is an implied warranty that goods or services are required to be of merchantable quality or fit for their intended purpose then the Company and the Purchaser agree that to the extent (if at all) that such legislation permits the warranty to be excluded or limited, the warranty is excluded and/or limited to the fullest extent permitted by law.
Merchantable Quality. Merchant shall be solely responsible to assure that all Subject Commodities sold by Merchant are of merchantable quality, unadulterated and unrestricted from movement and sale under all applicable federal and state laws and regulations.

  • Due Qualification The Servicer is duly qualified to do business as a foreign corporation in good standing, and has obtained all necessary material licenses and approvals, in all jurisdictions in which the ownership or lease of property or the conduct of its business (including the servicing of the Receivables as required by this Agreement) shall require such qualifications, except where the failure to be so qualified or to have obtained such licenses or approvals would not have a material adverse effect on the Servicer’s earnings, business affairs or business prospects.
