Licensee Remains Responsible. Licensee shall not sublicense space on or use of a BTU Eligible Pole to any third party. The Parties acknowledge and agree, however, that certain Network Nodes that Licensee may deploy, construct, install, repair, or maintain under the terms of this Agreement may be licensed, leased, owned, or operated by one or more Wireless Service Provider customers of Licensee (“Licensee’s Customers”) pursuant to license, lease, or sales agreements between Licensee and Licensee’s Customers. Such Network Nodes shall be treated as Licensee’s Network Nodes under this Agreement, and Licensee shall be responsible for performance of all of Licensee’s obligations under this Agreement with respect to all Network Nodes Licensee deploys, constructs, installs, repairs, or maintains on a BTU Eligible Pole.

Licensee Remains Responsible. (a) If the Licensor consents to the disclosure, distribution or supply of the Data to a contractor pursuant to clause 20.1, the Licensee is not relieved of any of its liabilities or obligations under this Agreement, and the Licensee is liable to the Licensor for the acts, defaults and neglects of any Contractor or any employee or agent of the Contractor as if they were the acts, defaults or neglects of the Licensee.
Licensee Remains Responsible. Licensee shall not sublease or sublicense space on or use of an Eligible Pole to any third party.

  • Client Responsibility For clarity, the parties agree that in reviewing the documents referred to in clause (b) above, Patheon’s role will be limited to verifying the accuracy of the description of the work undertaken or to be undertaken by Patheon. Subject to the foregoing, Patheon will not assume any responsibility for the accuracy of any application for receipt of an approval by a Regulatory Authority.   • Repair Responsibility Builder will repair only cracks exceeding 1/8 inch in width, one time only, during the first year of the Limited Warranty period.

  • Not Responsible SAP and its licensors will not be responsible under this Agreement (i) if the Software is not used in accordance with the Documentation; or (ii) if the defect or liability is caused by Licensee, a Modification or Add-on (other than a Modification or Add-on made by SAP which is provided through SAP Support or under warranty), or third-party software; or (iii) if the Software is used in conjunction with any third party software for which the Licensee lacks sufficient rights from the third party vendor for such use; or (iv) for any Licensee activities not permitted under this Agreement. SAP AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES ARISING FROM INHERENTLY DANGEROUS USE OF THE SOFTWARE AND/OR THIRD-PARTY SOFTWARE LICENSED HEREUNDER.

  • Vendor Responsibility The Department of Transportation has undertaken an affirmative review of the proposed consultant’s responsibility in accordance with the applicable standards outlined in Comptroller’s Bulletin No. G-221, and based upon such review, reasonable assurance that the proposed contractor is responsible has been determined.
