Leaves. 21.1 At the beginning of each work year, each bargaining unit member hired before July 1. 21.3 The Board shall furnish each bargaining unit member with a written statement at the rate beginning of one each school year setting forth the total accumulated sick leave credit for said bargaining unit member. For the purpose of computation of sick leave for bus drivers, the following shall govern:

If an employee utilizes Sick Leave In the case of probationary drivers, and is absent for more than four (4) consecutive work days, he/she must obtain medical certification from a health care provider substantiating the need for the leave of absence. Sick Leave shall be chargeable in half-day (1/2) increments, with the exception of Bus Drivers and Bus Attendants with regularly scheduled midday routes/runs for whom Sick Leave shall be chargeable in one-third (1/3) day increments.
5. If an employee exhausts his/her accrued sick leave, the Board will advance to him/her up to a maximum of five (5) days of sick leaveuntil such time as "probationary" has been defined, or the amount he/she can earn prior to June 30 of that one
(1) school year, whichever is lesssooner, sick leave shall be accrued on a monthly basisfor ten (10) months. If Once earned, sick leave may be accessed by the probationer as withany other driver.
5. Driver run credit shall be considered as the portal to portal driving time for the run, plus time for pre-and post check i.e., drivers shall receive a sick leave pay credit that is equal to theirregular run/daily pay rate).
21.4 A day is defined as the length of the employee's regularly scheduled workday. When an employee's hours are increased or decreased, the accumulation will be prorated.
21.5 It is the responsibility of each employee to report to his/her supervisor or designee unavailability for work prior to his/her normal starting time.
A. Each employee shall, at the time of reporting absence, state the reason for absence, where the employee leaves may be reached in case of emergency, and the employment anticipated length of an absence.
B. An employee utilizing sick leave days shall be considered continuously employed for purposes of computing benefits under this Agreement.
C. Insurance benefits shall cease to be paid for eligible employees upon exhaustion of the Board prior employee's sick leave accumulation and any eligible insurance benefits under the Family and Medical Leave Act. During all periods of unpaid absence, theemployee will assume responsibility for premium payments, if he/she elects to repaying continue those benefits.
21.6 Accumulated sick leave days may be utilized for the advanced sick leave, following reasons:

If an employee utilizes Sick Leave and is absent for five (5) or more than four (4) consecutive work daysworkdays and there’s reason to believe that there is an abuse of the sick leave, he/she must obtain medical certification the District may require a signed statement from a health care provider substantiating the need for the leave of absence. Sick Leave shall be chargeable in half-day (1/2) increments, with the exception of Bus Drivers and Bus Attendants with regularly scheduled midday routes/runs for whom Sick Leave shall be chargeable in one-third (1/3) day incrementslicensed physician.
5. If No extension of a leave of absence, or a second unpaid leave of absence shall be granted without the express approval of the Superintendent of Schools.
6. Any Employee who has been placed on layoff or who is on an employee exhausts unpaid leave of absence shall be provided insurance coverage at their own expense at the group rate for a period of at least but not more than twelve (12) months or the duration of the leave, whichever is longer. Any Employee who resigns shall cease to be entitled to such benefits as of the date that his/her accrued sick resignation becomes effective. In the event of an Employee taking an approved health leave, the Board Employee’s fringe benefits will advance to him/her up to a maximum of five be paid for the full twelve (512) days of sick leave, or month period providing that the amount he/she can earn prior to June 30 of that school year, whichever is less. Each full time employee of this unit district is entitled to sick leave as follows: Each employee employed before June 1, 2014 shall be given fifteen days of sick leave per year accumulative to 360 days of sick leave at full pay. If previously disabled employee decides to leave the employment with Gibson City-▇▇▇▇▇▇- ▇▇▇▇▇▇ Community Unit District No.5, the employee will be allowed to participate in the group insurance program at his/her up own expense under COBRA regulations, as in compliance with state and federal statuses relative to employment. Any employee who is anticipating a maximum disability and wishes to take a leave of five (5) days of sick absence prior to being incapacitated, or unable to work as certified by a licensed physician, may request such leave, or the amount he/she can earn prior to June 30 of that school yearbut such leave, whichever is lessif granted, will be without pay and fringe benefits. Leaves. 1The District and the Association agree that the highest quality of education is provided with the full-time teacher present in the classroom. Each person employed by Teachers are encouraged to make every effort to be in attendance for all the Board shall accrue fifteen (15) days Sick Leave with pay for each year of service, his/her contract. Sick Leave shall be chargeable in half-day (1/2) increments, with the exception of Bus Drivers and Bus Attendants with regularly scheduled midday routes/runs for whom Sick Leave shall be chargeable in one-third (1/3) day increments.
5. If an employee exhausts his/her accrued sick leave, the Board will advance to him/her employment up to a maximum of five (5) ten days a school year.
1. Credit for leave of sick leave, or the amount he/she can earn absence need not be accrued prior to June 30 of that taking the leave and leave may be taken at any time during the school year, whichever is less.
2. If the employee leaves does not take the employment full amount of leave allowed in any school year, the amount not taken shall be accumulated from year to year.
3. Accumulated sick leave accrued in another district shall be transferred to the District for newly hired certificated employees.
4. Leave may be taken on an hourly basis in units of one-sixth (1/6) for any absence for an hour or any part thereof. If a unit member voluntarily covers a period without taking a period substitute pay, no leave time shall be deducted from the absent unit member.
5. Absence due to illness should be arranged as soon as possible. The employee shall access the substitute placement/absence tracking system online or via phone at the earliest possible moment he/she is aware of the Board need for an absence. It is the employee’s responsibility to ensure absences are correctly entered into the system. The employee may use the automated system to create an absence up until two hours before school start time. Within two hours of the start of school, and for emergencies, the employee shall contact the District Substitute Line (▇▇▇-▇▇▇-▇▇▇▇, ext. 1555) to notify the District so that a substitute can be arranged. If an absence is to continue beyond the initial day, it is the employee’s responsibility to enter the absence into the system as soon as possible to arrange additional substitute coverage. Additionally, if an absence has been scheduled and is no longer needed, it is the employee’s responsibility to delete the absence more than 24 hours in advance. If the cancellation is within 2-4 hours of the planned absence, the employee must notify the District Office at the above listed number to ensure the substitute may be cancelled and notified. The teacher may request a substitute from the District’s list of substitutes using the preferences option of the substitute placement/absences tracking system. The District shall make every effort to provide the substitute requested. Placement of substitute teachers in the classroom is at the discretion of the District.
6. When an absence is to be longer than one (1) day, the employee must notify their school site or the District Substitute Line (▇▇▇-▇▇▇-▇▇▇▇, ext. 555) of an intention to return by 4 p.m. on the workday prior to repaying the advanced day of return. Failure to comply with this provision shall result in a written warning to the employee. Failure to comply a second time in a school year may result in deduction of the substitute‘s pay from the employee’s salary, provided the District is unable to cancel the substitute.
7. An employee shall be credited at his retirement for each day of accumulated or unused leave of absence for illness or injury for which full salary is allowed to which the employee was entitled on the final day he rendered service to the District.
8. Pay for any day of such absence shall be the same as the pay which would have been received had the employee served during the day.
9. An employee shall not be required to secure advance permission for the following reasons:
a. When an employee is ill or injured to a degree so as to be unable to satisfactorily perform regular duties.
b. When an illness or injury may be aggravated to the detriment individual welfare by continued service.
c. Serious illness of a member of the employee’s immediate family of a severity that requires constant attention or a physician.
d. Quarantine for contagious disease leave beyond accumulated sick leave is subject to board action.
e. The necessity to take a dependent member of the employee’s family to a healthcare provider for evaluation or treatment.
10. Any time this policy is invoked by an employee, reasonable notice, when possible, must be given to the immediate supervisor or the District to provide for a temporary replacement.
11. The administration shall verify reason for absence. Leave may be claimed only for the reasons provided in this Article. All absences from duty for one day or more shall be verified according to the following procedure:
a. A verification of absence form shall be completed immediately upon return to duty and shall give a reason for the absence. The immediate supervisor shall review this completed form and verify the reason for absence.
b. Employees returning from prolonged illness (more than five days) may be asked to verify to the satisfaction of the immediate supervisor that absence from duty resulted from instructions issued by a licensed physician or other licensed practitioner.
12. Unit members who have used all leave time granted for the school year (usually ten days as outlined in Paragraph B) ▇▇▇ also request additional leave time for illness. The unit member may use accumulated sick leave. If the unit member does not have any accumulated sick leave, the outstanding balance will District shall grant the leave time and differential pay (the unit member’s daily rate less the cost of the substitute) shall be deducted from provided with a verification of illness by a physician. If the physician’s verification is not provided, the leave time shall be granted without pay. Accumulated sick leave may also be used for care of an immediate family member as described in Paragraph A.
13. After written notification by their site principal, employees who abuse leave privileges may also be required to produce a physician’s verification for any final payments leave time due to the employee by the Boardillness regardless of accumulated sick leave availability.

2. "“Immediate family" Family” shall be defined as husbandspouse, wifemother, father, step-mother, step-father, children, father, motherstep-children, brother, sister, aunt, uncle, grandparents, current fathergrandchildren, niece and nephew, parents-in-law, current motherson-in-law, current daughter-in-law, brother-in-law, and sister-in-law, current brother-in-lawexcept when applying FMLA at which time the FMLA definitions of "Immediate Family" apply.
Section 1: Sick leave policies for teachers shall consist of eleven (11) days per year for illness, grandchildcumulative to one hundred and forty (140) days. Six of the 11 sick days shall be granted at the beginning of each year, or any person residing the remaining five sick days will be granted at the beginning of second semester. A doctor’s statement may be requested for approval by the Administration. If such statement is requested by the Board, the Board shall pay for such examination, provided the teacher shall be examined by a doctor of the Board’s selection.
Section 2: Sick leave use shall normally be limited to personal illness. However, a teacher may use up to ten (10) days per year of his accumulated sick leave for the care of members of the teacher’s immediate family for which other adult supervision cannot be arranged.
Section 3: Bereavement Leave - Beginning in the bargaining unit member's home for whom 2013-2014 school year, a teacher shall be allowed a maximum of one (1) day of absence without loss of salary or deduction from accumulated sick leave or personal business leave, upon the employee has assumed death of a reasonable responsibility for caremember of the immediate family. Additions Up to this list two (2) additional bereavement leave days may be taken from accumulated sick leave or personal business leave. The teacher must notify the District office. Additional days, up to five, may be granted upon request and upon submitting a written request to and receiving approval from the Superintendent to take care of unusual travel requirements or personal problems in connection with the use of the above bereavement leave. Any additional time granted beyond the three (3) days provided for above, will be taken from accumulated sick leave or personal business leave. If no sick leave or personal business leave is available, bereavement time may be granted without pay.
Section 4: Beginning in the 2013-2014 school year, leave of three (3) days per year shall be allowed for personal business. Prior arrangements must be made at least 72 hours in advance, except in case of emergencies, with the Superintendent or the Building Principal. This leave is not accumulative nor shall it be taken on any day immediately preceding or following any vacation period or holiday, except as approved by the Superintendent. Unused Sick Leave shall be accumulative for the period of time that an employee works for the Board. Sick Leave accrual shall be unlimited. Sick Leave compensation shall be based upon an employee’s regularly assigned hours (i.e., it does not include any special or overtime assignments, including bus drivers’ field trips).

(a) Leaves taken under this section shall be for the purpose of conducting business which cannot be conducted at a time other than during the school day.
(b) Unused personal business days shall be added to the teacher’s sick leave accumulation at the conclusion of the school year. Such accumulation shall be without restriction to the number of sick leave, or the amount he/she can earn prior to June 30 leave days which could otherwise be accumulated under Section A (1) of that school year, whichever is less. If the employee leaves the employment of the Board prior to repaying the advanced sick leave, the outstanding balance will be deducted from any final payments due to the employee by the Boardthis Article.

Leaves. Each full time employee of this unit district is entitled to sick leave as follows: Each employee employed before June 1, 2014 shall be given fifteen days of sick leave per year accumulative to 360 days of sick leave at full pay. Each person employee employed by the Board shall accrue fifteen (15) days Sick Leave with pay for each year of serviceon or after June 1, which 2014 shall be credited given fifteen days of sick leave per year accumulative to 220 days of sick leave at the rate of one and one-fourth (1-1/4) days per month.

If previously disabled employee decides to leave the employment with ▇▇▇▇▇▇ City- ▇▇▇▇▇▇-▇▇▇▇▇▇ Community Unit District No.5, the employee will be allowed to participate in the group insurance program at his/her up own expense under COBRA regulations, as in compliance with state and federal statuses relative to employment. Any employee who is anticipating a maximum disability and wishes to take a leave of five (5) days of sick absence prior to being incapacitated, or unable to work as certified by a licensed physician, may request such leave, or the amount he/she can earn prior to June 30 of that school yearbut such leave, whichever is lessif granted, will be without pay and fringe benefits. Section 2 - Sick Leave
1. All newly hired Employees will be credited with five (5) sick days on the Employee`s first (lst) day of service. After the Employee completes five (5) full calendar months (each of which begins on the first (lst) of the month), the Employee will, thereafter, be credited with sick leave at the rate of one (1) day per completed calendar month.
2. All current Employees will be credited with sick leave at the rate of one (1) day per completed calendar month. Earned sick leave not taken in any calendar year will be Accumulated. Sick leave is defined as absence from duty because of illness; pregnancy; child birth; injury; quarantine resulting from exposure to contagious disease; family illness and bereavement leave. The Department Head or the Commissioner of Human Resources may require such substantiation of sick leave as deemed necessary.
3. Sick leave credits may not be earned while on leave with- out pay, on military leave of over thirty (30) days, on extended sick leave, or while using sick bank time.
4. Any Employee, who is eligible for retirement and retires, and who has at least fifty (50) sick leave days on the amount he/she can earn prior to June 30 books at the time of that school yearretirement, whichever is less. If shall receive the employee leaves the employment following: a full day's pay for one-half (1/2) of the Board prior to repaying accumulated amount of days. However, in no event shall any Employee receive more than one hundred and twenty five (125) days of pay. It is understood that the advanced sick leaverate of pay shall be the current rate of pay for each Employee. For purposes of this provision, retirement shall mean the outstanding balance will be deducted receipt of a retirement benefit from the New York State Retirement System or a lay-off or any final payments due other involuntary removal from payroll which shall include payment to the employee by the Boardemployee’s estate upon death. Excluded is dismissal for cause (discipline) or resignation.
