Common use of Jury and Witness Duty Leave Clause in Contracts

Jury and Witness Duty Leave. Article 15:05 applies with the following amendments: In the event an Employee is subpoenaed to act as a witness in a Criminal or Civil Court or at a Coroner’s Inquest as a result of an action arising out of the Employee’s duties, and the day(s) falls on a regularly scheduled day off, the Employer will endeavour to adjust the work schedule so there is no loss of regular earnings or days off. Employees will be required to advise the Employer immediately upon receipt of any notification of such appearance or as soon as it is practicable. In the event the Employer is not able to adjust the work schedule the overtime provisions shall apply. If the Employee does not notify the Employer immediately the overtime provisions will not apply.
