How the Project Will Meet the Project XL Acceptance Criteria. A. Anticipated Superior Environmental Performance Reinventing environmental protection is more than fine-tuning the current regulatory system. It involves looking to the future and exploring and testing different approaches to environmental regulation that can help maximize resources to achieve enhanced environmental performance. To a large degree, these approaches willstemfromtechnology advancements, the need for operational flexibility and from a desire by many regulated facilities to move "beyond compliance" and achieve truly superior environmental performance. Gold Track represents New Jersey’s attempt to frame a new regulatory approach that strives to acknowledge and reward those facilities that achieve and maintain a high level of environmental performance. This Agreement outlines the baseline general commitments and incentives that will be used to evaluate the achievement of superior environmental performance. How the Project Will Meet the Project XL Acceptance Criteria. 3.1 Anticipated Superior Environmental Performance The use of OMP’s high-temperature catalytic oxidation process, which treats the LLMW test samples as they are generated, potentially results in several environmentally superior benefits as compared to presently available commercial treatment and disposal alternatives involving incineration or land disposal: - The radioactive component of OMP’s LLMW is captured as a uniform, consistent waste stream and is amenable to recovery and reuse. - Under OMP’s proposal, all LLMW is handled on-site, in the NRC-regulated, controlled laboratory environment in which it is generated, thereby further reducing the minimal potential for spills or releases during on-site and off-site handling and transportation.
How the Project Will Meet the Project XL Acceptance Criteria. The PPG Project, described in this Agreement, meets EPA's Project XL criteria. See 60 Fed. Reg. 27, 282, et seq. (May 23, 1995). The criteria and the basis for stating that they are met are summarized below.

  • Project Goals The schedule, budget, physical, technical and other objectives for the Project shall be defined.

  • Project Specific Milestones In addition to the milestones stated in Section 212.5 of the Tariff, as applicable, during the term of this ISA, Interconnection Customer shall ensure that it meets each of the following development milestones:

  • Project/Milestones Taxpayer develops and manufactures various products for use in the defense, aerospace and security industries. In consideration for the Credit, Taxpayer agrees to expand its operations at various locations throughout California, including El Segundo, Redondo Beach, Palmdale, Sunnyvale, Woodland Hills, Azusa and Rancho Xxxxxxxx. As part of its expansion, Taxpayer will invest in manufacturing equipment, computer and electrical equipment and make tenant improvements to the above facilities. Additionally, Taxpayer will hire full-time employees as part of its expansion (collectively, the “Project”). Further, Taxpayer agrees to satisfy the milestones as described in Exhibit “A” (“Milestones”) and must maintain Milestones for a minimum of three (3) taxable years thereafter. In the event Taxpayer employs more than the number of Full- time employees, determined on an annual full-time equivalent basis, than required in Exhibit A, for purposes of satisfying the “Minimum Annual Salary of California Full-time Employees Hired” and the “Cumulative Average Annual Salary of California Full-time Employees Hired,” Taxpayer may use the salaries of any of the Full-time employees hired and retained within the required time period. For purposes of calculating the “Minimum Annual Salary of California Full-time Employees Hired” and the “Cumulative Average Annual Salary of California Full-time Employees Hired,” the salary of any full-time employee that is not employed by the taxpayer for the entire taxable year shall be annualized. In addition, Xxxxxxxx agrees that any full-time employee hired after the effective date of this agreement that is a “qualified full-time employee” (as defined in RTC section 23636) shall be excluded from the calculation of the net increase of full-time employees required by this Agreement if Taxpayer claims the credit allowed by RTC section 23636.

  • Construction Development of the Project The Allottee has seen the proposed layout plan/demarcation-cum-zoning/sanctioned plans, / site plan / building plan, specifications, amenities and facilities, etc. depicted in the advertisement / brochure / agreement / website (as the case may be) regarding the Project where the Said Independent Floor for residential usage along with parking is located and has accepted the floor / site plan, Payment Plan and the specifications, amenities, facilities, etc. [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the bye-laws such as Haryana Building Code, 2017, FAR, density norms, provisions prescribed, approved plans, terms and condition of the license/ allotment as well as registration of RERA, etc. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the provisions and norms prescribed by the relevant State laws and shall not have an option to make any variation/ alteration/ modification in such plans, other than in the manner provided under the Act and Rules made thereunder or as per approvals/instructions/ guidelines of the competent authorities, and any breach of this term by the Promoter shall constitute a material breach of the Agreement.

  • TASK 1 GENERAL PROJECT TASKS PRODUCTS

  • Development of the Project 4.1 TSP's obligations in development of the Project: Subject to the terms and conditions of this Agreement, the TSP at its own cost and expense shall observe, comply with, perform, undertake and be responsible:

  • Drawings and Specifications at the Project Site The Contractor shall keep at the Site at least one copy of the Contract Documents and Change Orders, all in good order and available to the Design Professional and to his representatives.

  • Scope of the Project Under this Agreement, the scope of the Project (the “Scope of the Project”) shall mean and include:

  • Project Completion Date It is agreed between the Parties that the Project Completion Date is <END DATE, YEAR>. If the Project is not completed by such date then, subject to an amendment agreed to between the Parties, Alberta Innovates may elect to terminate this Investment Agreement. In such event, Alberta Innovates will notify the Applicant of its decision to terminate as soon as reasonably practical and shall advise the Applicant of the effective date of termination. Alberta Innovates will have no liability or obligation to reimburse the Applicant for any Project Costs incurred after the effective date of termination and may require the Applicant to return any portions of the Investment which were spent on Ineligible Expenses. Additionally, any portion of the Investment not used and accounted for in accordance with this Agreement as of the Project Completion Date or earlier termination is repayable by the Applicant to AI at AI’s request.

  • Project Completion Part 1 – Material Completion
