Grading and Site Development. Upon completion of the Mining and CCDD program contemplated by the Operations Agreement as reflected in the Land Reclamation, Operations and Implementation Plan, HEARTLAND shall be permitted to apply to the VILLAGE for redevelopment as permitted in the M-1 District under the Sugar Grove Zoning Ordinance. The Operations of the Clean Construction and Demolition Debris portion of the Land Reclamation, Operations and Implementation Plan shall not commence until the Illinois Environmental Protection Agency issues a CCDD Permit, provided that HEARTLAND may accept Uncontaminated Soil Fill as soon as it registers as a Soils Only Site with the IEPA. Construction and on-going maintenance of a truck wheel wash is required and is the responsibility of HEARTLAND and shall be used for each truck leaving the Property on every such occasion. The gravel aggregate access roads beyond the truck wheel wash is hereby permitted by the VILLAGE. A 30 foot wide paved access road from the right of way shall extend a minimum of 355 feet into the property.
