Common use of Failure of Allottee to take Possession of Apartment Clause in Contracts

Failure of Allottee to take Possession of Apartment. Upon receiving a written intimation from the Vendor/ Developer as aforesaid, the Allottee shall take possession of the Apartment from the Vendor/ Developer by executing necessary indemnities, undertakings and such other documentation as required and the Vendor/ Developer shall give possession of the Apartment to the Allottee. In case the Allottee fails to take possession within the time provided hereinabove , such Allottee shall continue to be liable to pay Maintenance Charges as specified from the date of (“Deemed Possession”) and also pay Holding Charges to the Vendor/ Developer at the rate of Rs. 2,000/- (Rupees Two thousand) only per month or part thereof from the expiry of the time mentioned in the possession letter till such time the Allottee (s) takes the possession of the apartment.
