The EPA O3 Flex Guidelines state that “ by developing, signing and maintaining such an agreement, a specific area would remain designated attainment for the 1-hour ozone standard for a limited period of years, as long as the control measures in the agreement are being implemented.” EPA agrees to defer redesignation of the A/SM MSA attainment area to nonattainment for the 1- hour ozone standard for the duration of this agreement, even if a violation occurs, as long as the control strategies are being implemented.
