Enforcement Costs and Attorneys Fees. If any legal action or other proceedings, including arbitration, is brought for the enforcement of this Addendum, or because of an alleged dispute, breach, default, or misrepresentation in connection with any provision of this Addendum, each Party will hereby be responsible for its own costs and attorneys’ fees.

For purposes of this Agreement, any settlement agreement which provides for payment of any amounts in settlement of the Bank's obligations hereunder shall be conclusive evidence of the Officer's entitlement to payments under this section, and any such payments shall be in addition to amounts payable pursuant to such settlement agreement, unless such settlement agreement expressly provides otherwise.

Boat Owner shall pay and discharge all costs, expenses, and attorney’s fees, which may be incurred by the City in enforcing the covenants of the Lease Agreement, including but not limited to collecting any sums due under this Agreement and enforcing the termination provisions and any maritime or other liens.

Secured Party’s remedies under this Security Agreement shall be cumulative, and Secured Party shall not be obligated to exercise any remedy before any other remedy, nor shall Secured Party be precluded from exercising any remedy because it has not first exercised any other remedy.
