Employment T&. Cs Impact of the different options in relation to application of TUPE, employment liabilities and obligations, equal pay disparities etc TUPE would apply to all options and would result in all employment liabilities and obligations transferring to whichever vehicle is chosen. However the parties can agree how any liabilities / employments costs will be apportioned in their commercial agreements. Equal pay and discrepancies between transferring staff will be an issue but is the same for all options. Terms and conditions cannot be changed post transfer without the risk of the transferee receiving claims that the changes are connected to the transfer. Ability to change terms and conditions would be dependent on the transferee showing that there was an economic, technical or organisational reason for the change (which leads to changes in the workforce) and that the change was not just a consequence of the transfer.

  • Outside Employment Employees may engage in other employment outside of their State working hours so long as the outside employment does not involve a conflict of interest with their State employment. Whenever it appears that any such outside employment might constitute a conflict of interest, the employee is expected to consult with his/her appointing authority or other appropriate agency representative prior to engaging in such outside employment. Employees of agencies where there are established procedures concerning outside employment for the purpose of insuring compliance with specific statutory restrictions on outside employment are expected to comply with such procedures.

  • Re-employment An employee who resigns her position and within sixty (60) days is re-employed, shall be granted a leave of absence without pay covering those days absent and shall retain all previous rights in relation to seniority and other fringe benefits subject to any benefit plan eligibility requirements.

  • EMPLOYMENT Company hereby employs Executive, and Executive hereby accepts such employment, upon the terms and conditions set forth herein.

Notwithstanding the foregoing, the Period of Employment is subject to earlier termination as provided below in this Agreement.

  • Employment Period The Company hereby agrees to continue the Executive in its employ, and the Executive hereby agrees to remain in the employ of the Company subject to the terms and conditions of this Agreement, for the period commencing on the Effective Date and ending on the third anniversary of such date (the "Employment Period").
