Emergent & Marginal Vegetation a. Plants Materials to be planted shall be either seed grown reeds of a provenance suitable for the site conditions or clumps of minimum size 300 x 300 mm, excluding top growth, excavated from an approved source of established material. All reeds and growing media shall be free from pests, disease, weed / grass species or polluted / contaminated material. Planting species shall include, but not be limited to, a selection of the following species, in % mixes specified for the specific site requirement: Typha latifolia, Phragmites australis, Scirpus lacustrus, Iris pseudoacorus, Juncus effuses. In special circumstances, other species may be utilised in accordance with the contract drawings or as otherwise directed by the Contract Administrator. The emergent and marginal species shall be pot grown in a container with a volume not less than 200cc in a potting medium of base fertilizer, 6-9 month formulation controlled release fertilizer (CRF) and a 12-14 month formulation CRF, with three to four shoots per pot with an extensive root and rhizome system formed in the pot. If the emergent and marginal are not planted in ideal conditions then the planting stock shall be grown in a container with a volume not less than 300cc in a potting medium of base fertilizer, 6-9 month formulation controlled release fertilizer (CRF) and a 12-14 month formulation CRF, with four to five shoots per pot with extensive root and rhizome system formed in the pot. Plants shall be live, fresh, healthy, and uninjured at the time of planting. Plants required for planting between March to June should be over wintered stock, plants required for planting between late June to September can be from the same growing season providing they show a well established root ball and good rhizomes present, approximately 300 mm of green leaf tissue above the root crown (these plants will have been potted before mid-April). Plants shall be kept continually moist and shaded until they are planted by covering with wet burlap or by other method approved by the Contract Administrator.

  • Aggravating and Mitigating Factors The penalties in this matter were determined in consideration of all relevant circumstances, including statutory factors as described in CARB’s Enforcement Policy. CARB considered whether the violator came into compliance quickly and cooperated with the investigation; the extent of harm to public health, safety and welfare; nature and persistence of the violation, including the magnitude of the excess emissions; compliance history; preventative efforts taken; innovative nature and the magnitude of the effort required to comply, and the accuracy, reproducibility, and repeatability of the available test methods; efforts to attain, or provide for, compliance prior to violation; action taken to mitigate the violation; financial burden to the violator; and voluntary disclosure. The penalties are set at levels sufficient to deter violations, to remove any economic benefit or unfair advantage from noncompliance, to obtain swift compliance, and the potential costs, risks, and uncertainty associated with litigation. Penalties in future cases might be smaller or larger depending on the unique circumstances of the case.

  • Subloop Elements 2.8.1 Where facilities permit, BellSouth shall offer access to its Unbundled Subloop (USL) elements as specified herein.

  • Service Rates The rates for services provided to a specific child by the Provider shall be set forth in the PSO for the child. The Provider may not increase the rate for any service described in a PSO during the term of the PSO unless the PSO provides for an automatic rate increase option, in which case the rate may only be increased in the initial month of the Buyer’s fiscal year and must be agreed to in writing by the Buyer. The provider is required to have all services and rate information entered and up-to-date in the Service Fee Directory by the beginning of the contract year. The Provider shall provide to the Buyer written notice of any planned rate increase (90 days) prior to the initial month of the Buyer’s next fiscal year. Such written notice shall contain the justification for the increase and shall be submitted in triplicate to the Buyer’s Children’s Services Act Manager.

  • Uncontrollable Forces Tariff Provisions Section 14.1 of the CAISO Tariff shall be incorporated by reference into this Agreement except that all references in Section 14.1 of the CAISO Tariff to Market Participants shall be read as a reference to the Participating Generator and references to the CAISO Tariff shall be read as references to this Agreement.

  • Commingling of Resold Services with Unbundled Network Elements and Combinations of Unbundled Network Elements 6.7.1 To the extent it is Technically Feasible and pursuant to the terms of Section 9.1, CLEC may Commingle Telecommunications Services purchased on a resale basis with an Unbundled Network Element or combination of Unbundled Network Elements.

  • Multiple Listing Service (MLS) Due to rules administered by the local Multiple Listing Service (“MLS”), all details of any transaction that are procured by the Agency may be used for publication in the MLS. Seller hereby consents to such publication on an unrestricted basis whereas the Agency must comply with all applicable MLS rules to allow data about the Property to be shown and made available by the MLS in addition to other internet websites. MLS rules generally provide that any property entered into its database be updated within forty-eight (48) hours, or some other period of time, after all necessary signatures have been obtained in regard to the Property. Seller has the right to prohibit any and all publication of information in regard to a transfer of the Property. In order to exercise this right, the Seller is required to authorize a separate addendum provided by the Agency and attach to this Agreement.
