Common use of Daily Premium Pay Clause in Contracts

Daily Premium Pay. All non-exempt employees shall receive premium pay of time and one-half (1 1/2) their regular straight time hourly rate of pay for all hours worked in excess of eight (8) hours per day. However, any shift that begins prior to 12 midnight, but ends after 12 midnight, shall be treated as one day for the purpose of computing pay rates. The time and one-half (1 1/2) premium after eight (8) hours shall not be applicable to employees regularly scheduled for ten hour days.

The time and one-half (1 1/2) premium after eight (8) hours shall not be applicable to employees regularly scheduled for ten hour days.eight

The time and one-half (1 1/21½) premium after eight (8) hours shall not be applicable to employees regularly scheduled for ten (10) hour days. This section shall not apply to Banquet Servers.
