HOURS OF WORK, OVERTIME AND PREMIUM PAY. 1. No Guarantee - This Agreement constitutes no guarantee of hours or periods of work.

HOURS OF WORK, OVERTIME AND PREMIUM PAY. A. The provisions of this Article are intended to provide a base for determining the number of hours of work for which an employee shall be entitled to be paid at overtime rates and shall not be construed as a guarantee to such employee of any specified number of hours of work, either per day or per week, or as limiting the right of the City to fix the number of hours of work (including overtime) either per day or per week for such employee. The department shall post two (2) two-week schedules in such a manner that the current schedule shall be accompanied by the succeeding two week schedule. B. The standard pay period for computing pay will begin at the start of the “day” shift, Sunday, and extend until the end of the “night” shift fourteen (14) days hence, averaging a forty-two (42) hour week or eight-four (84) hour pay period. Employees who are scheduled for mandatory training will receive pay for all time spent in training and suitable travel time. Days off may be changed for employees who are scheduled for mandatory training. The days off must be rescheduled within the same pay period in which the training is scheduled. The Public Safety Director shall determine which training is mandatory. C. Hourly employees working over twelve (12) hours in one day will be paid at a rate of time and one- half (1-1/2 x) of their regular hourly rate for the time worked over twelve (12) hours. Command unit employees working in excess of seven (7) days and eight-four (84) hours during a standard pay period of two (2) weeks, will be paid at a rate of time and one-half (1-1/2 x) of their regular hourly rates. 1. Detectives receive overtime pay at a rate of time and one half for all hours worked in excess of 40 in a work week. Management reserves the right to “flex” schedules. For purposes of this section, the Detective Lieutenant shall be included in overtime pay. HOURS OF WORK, OVERTIME AND PREMIUM PAY. 4.1 Hours of Work - A regular shift shall be eight (8), ten (10) or twelve (12) consecutive hours in any day. The Work week shall consist of five (5) consecutive shifts of eight (8) hours or four (4) consecutive shifts of ten (10) for a total of forty (40) hours. G. Employees working on regular shift shall receive a shift differential of thirty-five (35) cents per hour for hours worked between the hours of 4:00 p.m. and 12:00 a.m. or 3:00 p.m. and 11:00 p.m. if that is the scheduled shift; and forty (40) cents per hour for hours worked between the hours of 12:00 a.m. and 8:00 a.m. or 11:00 p.m. to 7:00 a.m. if that is the scheduled shift. H. A minimum of two (2) hours at time and one-half (1-1/2x) shall be paid an employee who returns to duty after having been released from regular day's work or on days other than his scheduled work days. An employee who answers an emergency call shall be considered as being on duty for the full two (2) hours, and another call within his two (2) hour period shall not entitle the employee to extra consideration beyond the time and one-half (1-1/2x) for actual time worked in excess of such two (2) hours. Hourly employees working in excess of 5 days and 40 hours during a standard week will be paid at a rate of time and one-half of their regular hourly rates. D. Hourly employees working over eight (8) hours in any one day will be paid at a rate of time and one-half of their regular hourly rate for the time worked over eight (8) hours. E. The hours of work and specific shift assignment will be determined by the Department Head, posted on the bulletin board, and will be adjusted when notice of change has been posted in advance. This applies only to the regular departmental hours and does not prohibit the Department Head from changing the hours of individual employees as the need arises. F. An employee will be paid a minimum of three hours at time and one-half any time they return to duty after having been released from a regular day’s work or on days other than the scheduled workdays. G. Scheduled overtime shall be posted a minimum of twenty-four (24) hours in advance. H. Employees responding to emergency calls on holidays will be paid a minimum of three (3) hours at the respective holiday rate. When a holiday falls on Sunday and is celebrated on a Monday, the provisions for holiday emergency call back shall apply to both days. When a holiday falls on a Saturday and is celebrated on a Friday, the provisions for holiday emergency call back shall apply to both days. I. HOURS OF WORK, OVERTIME AND PREMIUM PAY. 38 39 The University reserves the right to determine and/or amend daily 40 hours of work, weekly work schedules or standard work week and 41 pay day in conformance with all sections of this agreement. HOURS OF WORK, OVERTIME AND PREMIUM PAY. Section 1. Work Day and Work Week - 8 hours per day shall constitute a normal day's work.
