Covenant of Title. The Board herein warrants that there are no existing restrictions which may deny Lessee the use and occupancy of said premises or restrict its use thereof. Xxxxxx is solely responsible for obtaining the required occupancy permit from the City of Milwaukee and any required approvals of the Board of Zoning Appeals.

Covenant of Title. Owner shall enable Manager to peaceably and quietly operate the business in accordance with the terms of this Management Agreement.
Covenant of Title. Landlord covenants, represents and warrants that it has full right and power to execute and perform its obligations under this Lease and to grant the estate demised herein and that Tenant, on payment of the rent herein reserved and performance of the covenants and agreements herein contained, shall peaceably and quietly have, hold and enjoy the Demised Premises during the Demised Term without molestation or hindrance by any person, and, if at any time during the Demised Term, the title of Landlord shall fail or it shall be discovered that its title does not enable Landlord to grant the term hereby demised, or action is taken by governmental authority which prevents Tenant from using the Demised Premises for the use contemplated by it, Tenant shall have the option at Landlord's expense to correct or contest such defect or action, or to annul and void this Lease with full reservation of its rights to damages, if any, against Landlord.
Covenant of Title. Landlord covenants that it has full right, power and authority to make this lease, and that Tenant upon payment of the rentals and performance of the covenants upon Tenant's part to be performed hereunder, shall and may peaceably and quietly have, hold and enjoy the premises and improvements thereon during the term or any renewal or extension hereof. The above referenced covenants shall apply only to the Tenant hereunder and shall not be assignable to any assignee or subtenant under this lease should Landlord permit such an event.

Covenant of Title. Grantor, at its own expense, does hereby and shall forever warrant and defend to the Trustee for the benefit of Beneficiary, and its or their successors and assigns forever, title to the Property as described in Section 1.2.5 and the lien and interest of the Trustee created by this Deed of Trust on and in the Property, and the first priority thereof, against all claims and demands of any and all persons whomsoever, and shall maintain and preserve such title and lien so long as the Mortgage Note, the Loan Agreement, this Deed of Trust, or any other Loan Document is outstanding and until such time as all sums secured hereby and thereby have been paid in full and all other Obligations have been duly performed; and
Covenant of Title. At the time of the execution and delivery of this Mortgage, Borrower is well and truly seized of the Project in fee simple, free of all easements, liens and encumbrances whatever (other than those easements of record as of the date hereof and the rights of the public in any part of the Project used or taken for road purposes), and will forever warrant and defend the same against any and all other claims whatever, and the lien created hereby is and will be kept as a first lien upon the Project and every part thereof, subject only to the foregoing exceptions.
