Court Appearance After Late Shift. Whenever a member is required to appear as a witness, in any proceedings arising out of the performance of a Police duty as set forth in Paragraphs and above, in the forenoon after completing a scheduled tour of duty ending after midnight or any hour up to a.m. of the forenoon of such appearance, he shall be paid at the rate of time and one-half the regular hourly rate of pay, commencing at a.m., for a minimum period of not less than four (4) hours at the overtime rate for such appearance. If the time spent by a member on such appearance exceeds four (4) hours, then all time in excess of said four (4) hours shall be paid at two times the regularly hourly rate of pay. Provided, that upon request of the member concerned, compensating time off will be allowed in lieu of the overtime pay referred to above on the basis of one and one-half (1.5) hours for each hour to the credit of such member up to four (4) hours, and two (2) hours for each hour to the credit of such member in excess of four (4) hours.
