Class List Review. At least seven (7) days prior to any mailing of Notice, but in no event earlier than the date the Class List must be provided under Section 2.5.A, Defendants shall provide Class Counsel with the Class List, the number of hours worked by each Class Member who was or is an employee of the Club (“Hours Worked”), or with respect to Class Members engaged through a staffing agency, the number of Club events worked by each Class Member engaged through a staffing agency (“Events Worked”), along with a version of contemporaneously maintained documents that support those amounts. Defendants represent that the information provided as to Hours Worked and Events Worked are calculated based on the Club’s payroll records or the Club’s agreements with staffing agencies and that such records shall be available to Class Counsel. To the extent such information and/or documentation is not within Defendants’ possession but is instead in the possession of a third party such as a staffing agency, Defendants shall use reasonable efforts to cause the relevant third parties to provide records reflecting Events Worked to Defendants.

  • Drug-Free Workplace Certification As required by Executive Order No. 90-5 dated April 12, 1990, issued by the Governor of Indiana, the Contractor hereby covenants and agrees to make a good faith effort to provide and maintain a drug-free workplace. The Contractor will give written notice to the State within ten (10) days after receiving actual notice that the Contractor, or an employee of the Contractor in the State of Indiana, has been convicted of a criminal drug violation occurring in the workplace. False certification or violation of this certification may result in sanctions including, but not limited to, suspension of contract payments, termination of this Contract and/or debarment of contracting opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraph, if the total amount set forth in this Contract is in excess of $25,000.00, the Contractor certifies and agrees that it will provide a drug-free workplace by:

  • Contract Revisions Notwithstanding Contract Exhibit C, Special Contract Conditions section 6.9, the following types of revisions can be made to the Contract without a formal Contract amendment, upon written notice: Revisions by the Contractor:

  • Shift Schedule The words "shift schedule" when used in this Agreement shall mean a timetable of the shifts and off days assigned to a position or group of positions which commences at the beginning of a pay period and includes one complete rotation of said shifts.

  • Document Review The Company and the Executive hereby acknowledge and agree that each (i) has read this Agreement in its entirety prior to executing it, (ii) understands the provisions and effects of this Agreement, (iii) has consulted with such attorneys, accountants and financial and other advisors as it or he has deemed appropriate in connection with their respective execution of this Agreement, and (iv) has executed this Agreement voluntarily and knowingly.
